«Антивирусный пакет» разработан московским штабом по защите бизнеса с участием органов контроля, представителей сфер общепита, фитнеса, индустрии красоты и других бизнес-областей, сообщается на сайте Мэра Москвы. Документ1 представляет собой сборник инструкций на основе рекомендаций Роспотребнадзора, указов Мэра Москвы, приказов и распоряжений профильных органов исполнительной власти Москвы, который будет помогать предпринимателям соблюдать требования и рекомендации в период действия эпидемиологических мер. Также отмечается, что контрольные органы смогут применять данный сборник для более точного определения субъекта правонарушения (должностное или юридическое лицо).
В качестве образцов документов в «антивирусном пакете» представлены:
приказ о введении режима повышенной готовности в связи с угрозой распространения коронавирусной инфекции; приказ о тестировании работников на наличие коронавирусной инфекции, а также приказ о лабораторном исследовании методом иммуноферментного анализа (ИФА) с уведомлением работника о предстоящем исследовании и бланка согласия; рекомендации по заполнению журнала инструктажа для предупреждения распространения коронавирусной инфекции, журнала регистрации измерения температуры; приказ о ношении СИЗ на рабочем месте, журнал выдачи СИЗ сотрудникам; рекомендации по переводу отдельных сотрудников на дистанционный режим работы и бланк уведомления работника о запросе сведений для передачи информации в соответствии с указом Мэра Москвы от 8 июня 2020 г. № 68-УМ и другие.

Обращено внимание, что следование указанным рекомендациям поможет доказать добросовестность предпринимателей-работодателей, подтвердить юридический статус и реальность хозяйственных операций по профилактике коронавирусной инфекции. Применение данного комплекта в отдельных случаях может являться одним из доказательств отсутствия вины юрлица или ИП и поводом для составления протокола на должностное лицо. Кроме того, отмечено, что важно учитывать изменения в правовых нормах и иные индивидуальные обстоятельства, в связи с чем данный «антивирусный пакет» носит исключительно рекомендательный характер для предпринимателей – его использование, неиспользование (частичное использование) не является основанием к возбуждению дела об административном правонарушении по ст. 20.6.1 КоАП.
