Минэкономразвития России подготовило законопроект о внесении изменений в ст. 14 Федерального закона от 24 июля 2007 года № 209-ФЗ «О развитии малого и среднего предпринимательства в Российской Федерации» (далее – Закон № 209), которыми действующие ограничения на получение поддержки субъектами МСП, допустившими незначительные нарушения порядка и условий оказания поддержки, могут быть смягчены. Напомним, в соответствии с ч. 5 ст. 14 Закона № 209-ФЗ в оказании поддержки МСП должно быть отказано, если с момента признания субъекта МСП допустившим нарушение порядка и условий оказания поддержки, что включает в себя и условие о нецелевом использовании средств поддержки, прошло менее чем три года.
Законопроектом1 предлагается сократить указанный срок до одного года. При этом для условия о нецелевом использовании средств поддержки наряду с представлением недостоверных сведений и документов срок представления поддержки планируется не изменять – по истечении не менее трех лет с момента признания субъекта МСП таковым нарушителем.
Кроме того, предлагается не ограничивать меры поддержки в отношении тех субъектов МСП, которые устранили нарушения в срок, установленный органом, предоставившим меры поддержки.

Сообщается, что по представленным субъектами РФ сведениям, большинство нарушений порядка и условий оказания поддержки субъектов МСП являются незначительными. В случае принятия закона вступление его в силу запланировано с октября текущего года. Общественное обсуждение по законопроекту продлится до 2 июня.
