Постановлением Правительства от 11 декабря 2019 года № 1635 утверждены новые правила проведения обязательного общественного обсуждения закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд, которые начнут действовать с 1 января 2020 года. Одновременно с указанной даты действующие сегодня правила, утвержденные постановлением Правительства РФ от 22 августа 2016 года № 835 (далее – Правила от 22 августа 2016 г.), утратят свою силу.
Принципиальным отличием нового порядка является то, что со дня его вступления в действие обязательное общественное обсуждение для осуществления закупок при выполнении работ по строительству, реконструкции, капитальному ремонту, сносу объекта капитального строительства, если начальная (максимальная) цена такого контракта не превышает 2 млрд руб., проводиться не будет. Не предусматривается также и проведение общественного обсуждения госзакупок в два этапа.
Напомним, сегодня проведение общественного обсуждения закупок товаров (работ, услуг) для государственных и муниципальных нужд проводится в два этапа с направлением протоколов их проведения в органы, подведомственные Минфину России. Обязательно проведение общественного обсуждения для контрактов при начальной (максимальной) цене, равной или превышающей 1 млрд руб., но предусмотрены исключительные случаи, когда не требуется обязательное общественное обсуждение, в частности, при осуществлении госзакупок:
с применением закрытых способов определения поставщиков. Согласно ст. 84 Федерального закона от 5 апреля 2013 г. № 44-ФЗ «О контрактной системе в сфере закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд» (далее – Закон № 44-ФЗ) такие способы применяются только в случаях закупок товаров (работ, услуг) необходимых для обеспечения федеральных нужд, составляющих государственную тайну; заключения контрактов, где договором предусматриваются отношения в части страхования, транспортировки и охраны ценностей Госфонда драгоценных металлов и драгоценных камней РФ, музейных предметов, рукописей, документов, имеющих историческое, художественное или иное культурное значение; закупок по услугам уборки помещений, услуг водителей для обеспечения деятельности судей, судебных приставов (подп. «а» п. 2 разд. 1 Правил от 22 августа 2016 г.); в рамках гооборонзаказа (подп. «б» п. 2 разд 1 Правил от 22 августа 2016 г.); путем проведения повторного конкурса, электронного аукциона, запроса предложений (подп. «в» п. 2 разд. 1 Правил от 22 августа 2016 г.); путем проведения запроса котировок в целях оказания гуманитарной помощи либо ликвидации последствий чрезвычайных ситуаций природного или техногенного характера в соответствии со ст. 82 Закона № 44-ФЗ (подп. «г» п. 2 разд. 1 Правил от 22 августа 2016 г.). Следует отметить, что последнее основание новым постановлением исключено из перечня тех госзакупок, по которым общественное обсуждение может не проводиться.
Период проведения общественного обсуждения не подвергся изменению: его начало обозначено с даты размещения в единой информационной системе в сфере закупок плана-графика закупок и соответствующей информации об этом и заканчивается не позднее срока, до истечения которого определение поставщика может быть отменено в соответствии со ст. 36 Закона № 44-ФЗ. Закреплены положения об определении круга заказчиков, уполномоченных проводить общественное обсуждение, и его участников, которые могут оставлять замечания или предложения по поводу размещенного заказа, а также срок рассмотрения заказчиком таких замечаний и предложений.
Помимо этого, как известно, в соответствии с ч. 2 ст. 20 Закона № 44-ФЗ субъекты РФ вправе устанавливать в дополнение к правилам, установленным Правительством РФ, иные случаи проведения обязательного общественного обсуждения закупок для обеспечения нужд субъектов и муниципальных нужд, а также соответствующий порядок обязательного общественного обсуждения.
