Минфин России напомнил, как определить налоговый статус сотрудника для исчисления НДФЛ

Налоговым законодательством установлено, что налоговыми резидентами РФ признаются физлица, фактически находящиеся в России не менее 183 календарных дней в течение 12 следующих подряд месяцев (п. 2 ст. 207 Налогового кодекса). Период нахождения физлица не прерывается на время его выезда для краткосрочного (менее шести месяцев) лечения или обучения, а также для исполнения трудовых или иных обязанностей, связанных с выполнением работ (оказанием услуг) на морских месторождениях углеводородного сырья. 183 дня пребывания в РФ исчисляются путем суммирования всех календарных дней, в которые сотрудник находилось в России в течение 12 следующих подряд месяцев.

Как поясняет Минфин России, окончательный налоговый статус налогоплательщика, определяющий порядок налогообложения его доходов, полученных за налоговый период, определяется по его итогам (письмо Департамента налоговой политики Минфина России от 22 декабря 2020 г. N 03-04-06/112281).

В связи с распространением новой коронавирусной инфекции в 2020 году вышеуказанные нормы дополнены новым положением, согласно которому физлицо, фактически находящееся в РФ от 90 до 182 календарных дней включительно в течение периода с 1 января по 31 декабря 2020 года, также признается российским налоговым резидентом в налоговом периоде 2020 года. Для этого ему нужно представить в налоговый орган по месту своего жительства (в отдельных случаях в налоговый орган по месту пребывания или по месту постановки на учет) заявление, составленное в произвольной форме. В нем указывается Ф. И. О. и ИНН налогоплательщика. Подается уведомление в срок, установленный для подачи налоговой декларации – не позднее 30 апреля года, следующего за истекшим налоговым периодом (п. 1 ст. 229 НК РФ).

Возврат суммы НДФЛ налогоплательщику в связи с перерасчетом по итогу налогового периода в соответствии с приобретенным им статусом налогового резидента РФ производится налоговым органом, в котором он был поставлен на учет по месту жительства (месту пребывания), при подаче налогоплательщиком налоговой декларации по окончании указанного налогового периода, а также документов, подтверждающих статус налогового резидента (п. 1.1 ст. 231 НК РФ).
