В Госдуму внесен законопроект, предусматривающий поправки в налоговое законодательство в части введения освобождения от НДФЛ отдельных категорий доходов1. Предполагается, что поправки вступят в силу с момента опубликования соответствующего закона, до их действие распространится на правовые отношения, возникшие с 1 января 2021 года.
С 1 января 2021 года начала действовать норма, согласно которой НДФЛ облагается превышение суммы доходов в виде процентов, полученных налогоплательщиком в течение налогового периода по всем вкладам (остаткам на счетах) в указанных банках, над суммой процентов, рассчитанной как произведение одного миллиона рублей и ключевой ставки Банка России действующей на первое число налогового периода (ст. 214.2, ст. 217 Налогового кодекса).

Законопроектом предлагается установить освобождение от обложения налогом вышеуказанных доходов, получаемых неработающими пенсионерами. Законодатель полагает, что такая налоговая льгота должна предоставляться социально-слабым группам населения, таким как неработающие пенсионеры, наряду с уже действующими льготами по освобождению от НДФЛ пенсий, госпособий, социальных выплат, включая выплаты на детей, стипендии, помощь ветеранам Великой отечественной войны и другие. При этом предлагается освободить неработающих пенсионеров от уплаты НДФЛ с доходов в виде процентов по вкладам при условии, что такие доходы не превышают за налоговый период двенадцатикратной величины прожиточного минимума в целом по стране, установленного для пенсионеров на соответствующий год.
