С указанной даты начнут действовать новые положения Федерального закона от 7 августа 2001 года № 115-ФЗ «О противодействии легализации (отмыванию) доходов, полученных преступным путем, и финансированию терроризма» (далее – Закон № 115-ФЗ), касающиеся идентификации клиентов.
Так, в частности ст. 7 Закона № 115-ФЗ будет дополнена новым подп. 2.2, согласно которому организации, осуществляющие операции с денежными средствами или иным имуществом, а также ИП в случае непроведения идентификации или упрощенной идентификации клиента, представителя клиента, выгодоприобретателя и бенефициарного владельца, неустановления информации из подп. 1.1 п. 1 ст. 7, должны будут отказать клиенту в приеме на обслуживание. Ранее такая обязанность не конкретизировалась.
В связи с указанными изменениями, подготовлен проект Постановления Правительства1, вносящий изменения в ст. 28.1 Требований к правилам внутреннего контроля, разрабатываемым организациями, осуществляющими операции с денежными средствами или иным имуществом, и индивидуальными предпринимателями.
Указанные поправки приведут в соответствие эти два документа.
В случае одобрения изменений, новые требования к правилам внутреннего контроля вступят в силу одновременно с новыми положениями Закона № 115-ФЗ.
