Банк России разработал проект Указания «О порядке ведения кассовых операций с наличной иностранной валютой в уполномоченных банках на территории Российской Федерации». Он направлен на независимую антикоррупционную экспертизу, которая продлится до 17 декабря.
Документом1 планируется заменить действующее Указание Банка России от 14 августа 2008 г. № 2054-У «О порядке ведения кассовых операций с наличной иностранной валютой в уполномоченных банках на территории Российской Федерации». В частности, в новом порядке конкретизированы виды кассовых операций, проводимых в уполномоченных банках, – прием наличной иностранной валюты от клиентов (юрлиц, в том числе других уполномоченных банков, ИП и физлиц) для зачисления сумм наличной иностранной валюты на их банковские счета, счета по вкладам (депозитам), выдача наличной иностранной валюты клиентам со списанием сумм выданной валюты с их счетов.
Кроме того, в проекте закреплены:
обязанность уполномоченных банков обеспечить кассовых работников, ведущих кассовые операции, индивидуальными устройствами для хранения, штампами, в том числе именными, пломбами, клише, устройствами для считывания штрих-кода с упаковки валюты, позволяющими распознать упаковку с наличной иностранной валютой в автоматизированной системе уполномоченного банка (в случае их использования);порядок действий в случае недостачи наличной иностранной валюты на сумму равную или превышающую в эквиваленте 150 тыс. руб., произошедшей в результате действия (бездействия) работников уполномоченного банка;обязанность уполномоченного банка принимать от клиентов сомнительные банкноты для их передачи на экспертизу в подразделения Банка России;возможность подачи юрлицами и ИП заявок на сдачу или получение наличной иностранной валюты как на бумажном носителе, так и в виде электронного документа;содержание заявки на сдачу, получение наличной иностранной валюты.
При этом сохранены нормы об обязанности кассовых работников при приеме и пересчете наличной иностранной валюты определять, является ли принимаемая инвалюта законным средством наличного платежа на территории соответствующего иностранного государства, а также проводить проверку подлинности банкнот. Как и ранее, прописано, что прием наличной иностранной валюты для зачисления на банковский счет, счет по вкладу, выдача валюты со счетов должны осуществляться по приходному кассовому ордеру, расходному кассовому ордеру (они оформляются на каждое наименование наличной иностранной валюты).
Также проектом скорректирован порядок действий при выявлении кассовым работником несоответствия фактической суммы вносимой наличной иностранной валюты сумме, указанной в приходном кассовом ордере, а также при выявлении сомнительных банкнот и монет. Уточнен перечень форм приема и выдачи наличной иностранной валюты (отдельными корешками, пачками банкнот иностранных государств, сейф-пакетами, инкассаторскими сумками, мешками, кейсами, кассетами и другими средствами для упаковки валюты).
