Соответствующий Указ Президента РФ от 16 января 2020 года № 17 опубликован1 вчера на официальном интернет-портале правовой информации и вступил в силу с момента подписания.
До назначения Михаил Мишустин возглавлял Федеральную налоговую службу России, является действительным государственным советником Российской Федерации I класса. 15 января Владимир Путин инициировал перед депутатами Госдумы назначение Мишустина на пост премьер-министра, и в соответствии с ч. 1 ст. 103 Конституции Российской Федерации члены нижней палаты парламента согласились с предложенной Президентом РФ кандидатурой.
Ранее глава государства обратился к Федеральному Собранию РФ с посланием, в рамках которого озвучил предложения об изменении Основного закона страны, в том числе в части формирования высших органов государственной власти, вследствие чего был подписан2 указ об отставке Правительства РФ.
Также президентом принято решение о назначении Дмитрия Медведева заместителем Председателя Совета безопасности РФ (Указ Президента РФ от 16 января 2020 г. № 163).
Поскольку должность Заместителя Председателя Совета безопасности РФ в действующей редакции Федерального закона от 28 декабря 2010 г. № 390-ФЗ «О безопасности» (далее – Закон № 390-ФЗ) не предусмотрена, вчера Владимир Путин на рассмотрение Госдумы внес законопроект4 об изменении Закона № 390-ФЗ, устанавливающий порядок назначения Президентом РФ кандидата на указанную должность и освобождения от нее.
Напомним, Совет безопасности РФ является конституционным совещательным органом, осуществляющим подготовку решений Президента РФ по вопросам обеспечения национальной безопасности, организации обороны, военного строительства, оборонного производства, военного и военно-технического сотрудничества РФ с иностранными государствами, по иным вопросам, связанным с защитой конституционного строя, суверенитета, независимости и территориальной целостности РФ, а также по вопросам международного сотрудничества в области обеспечения безопасности. Согласно ч. 2 ст. 13 Федерального закона от 28 декабря 2010 г. № 390-ФЗ «О безопасности» Совет безопасности РФ формируется и возглавляется Президентом РФ.
