Как сообщает сайт ФНПР1, на прошедшем 23 июля заседании Российской трехсторонней комиссии по регулированию социально-трудовых отношений председатель ФНПР Михаил Шмаков высказал предложение об ознакомлении с Общенациональным планом действий по нормализации деловой жизни, восстановлению занятости, доходов граждан и роста экономики. По его словам, направление в Правительство РФ соответствующих запросов не привело к положительному результату в связи со статусом документа «для служебного пользования». Однако, по его мнению, представители профсоюзов и бизнеса должны получить доступ к документу и рассмотреть его на площадке РТК. Заместитель Председателя Правительства РФ Татьяна Голикова пообещала данную информацию довести до премьер-министра РФ и соответствующих координаторов.
Комиссия обсудила внесение изменений в Трудовой кодекс в части регулирования дистанционной и удаленной работы. О разработке соответствующего законопроекта портал ГАРАНТ.РУ писал ранее. Стороны РТК договорились о совместном обсуждении поправок до их внесения на второе чтение в Госдуме.
Участниками обсуждения также был рассмотрен законопроект о внесении изменений в Федеральный закон от 19 февраля 1993 г. № 4528-I «О беженцах». Обсужден порядок прохождения и объем обязательного медицинского освидетельствования соискателей статуса беженца. Законопроект был принят всеми сторонами РТК.
Еще одним предметом для обсуждения стал пакет проектов федеральных законов по обеспечению сохранности жизни и здоровья пассажиров городского транспорта (проект Федерального закона «Об особенностях допуска отдельных категорий лиц к осуществлению деятельности, непосредственно связанной с управлением транспортными средствами и о внесении изменений в Федеральный закон «О государственной регистрации юридических лиц и индивидуальных предпринимателей»), который предполагает запрет на управление общественным транспортом для водителей, имеющих судимость за тяжкие и особо тяжкие преступления. Указанный запрет предлагается распространить, в том числе и на регистрацию в качестве ИП с намерением осуществлять деятельность в сфере пассажирских перевозок (о данной инициативе портал ГАРАНТ.РУ рассказывал ранее).
Председатель ФНПР Михаил Шмаков отметил, что законопроект требует доработки ввиду избыточности требований об отстранении работника от работы, поскольку в ст. 76 ТК РФ предусмотрено, что работодатель имеет на это право только по требованию уполномоченных органов и должностных лиц, а не «по получению сведений». Президент Российского союза промышленников и предпринимателей Александр Шохин выразил сомнение в целесообразности включения в «частный» закон норм, касающихся регулирования трудовых отношений.

В РТК также обсудили вопросы систематизации обязательных требований в сфере специальной оценки условий труда. Соответствующим законопроектом предлагается внести изменения в Федеральный закон от 28 декабря 2013 г. № 426-ФЗ «О специальной оценке условий труда», установив бессрочное действие декларации соответствия условий труда государственным нормативным требованиям охраны труда в случае сохранения условий и организации труда на данном рабочем месте. Сегодня такая декларация действительна в течение пяти лет. Стороны поддержали данный законопроект.
В ходе обсуждения иных вопросов обращено внимание на необходимость ускорения разработки производственного календаря на 2021 год, передачи на рассмотрение региональными РТК вопроса организации отдыха и оздоровления детей для сохранения детских оздоровительных лагерей. Михаил Шмаков рассказал также о том, что профсоюзная сторона РТК выступает за доработку законопроекта о внесении изменений в Федеральный закон от 26 октября 2002 г. № 127-ФЗ «О несостоятельности (банкротстве)» в части положения о запрете на создание профсоюзов арбитражными управляющими, поскольку это, по его мнению, противоречит нормам ТК РФ и Конституции Российской Федерации.
