Правительство РФ определило минимальную обязательную долю закупок российских товаров (в том числе товаров, поставляемых при выполнении работ, оказании услуг) отдельных видов, при осуществлении закупок которых установлены ограничения для товаров из иностранных государств, определенную в процентном отношении к объему закупок товаров, осуществленных заказчиком в отчетном году (постановление Правительства РФ от 3 декабря 2020 г. № 2014).
Перечень соответствующих товаров включает 107 видов отечественной продукции. Определено, что для целей достижения минимальной доли закупок заказчиком могут учитываться товары, происходящие из государств – членов ЕАЭС. Постановлением также установлены особенности определения начальной (максимальной) цены контракта, цены контракта, заключаемого с единственным поставщиком, начальной цены единицы товара для цели достижения минимальной доли закупок.
Так, при определении идентичности и однородности товаров в соответствии с ч. 13 – ч. 14 ст. 22 Федерального закона от 5 апреля 2013 г. № 44-ФЗ «О контрактной системе в сфере закупок товаров, работ, услуг для обеспечения государственных и муниципальных нужд» (далее – Закон № 44-ФЗ) заказчик должен учитывать исключительно товары, происходящие из государств – членов ЕАЭС, в том числе включенные в реестр промышленной продукции, произведенной на территории РФ, реестр промышленной продукции, произведенной на территории ЕАЭС, за исключением РФ, предусмотренные постановлением Правительства РФ от 30 апреля 2020 г. № 616, единый реестр российской радиоэлектронной продукции, предусмотренный постановлением Правительства РФ от 10 июля 2019 г. № 878, а также включенные в каталог товаров, работ, услуг для обеспечения госнужд функциональные, технические, качественные и эксплуатационные характеристики (при наличии) соответствующих товаров.
При анализе рынка заказчик должен направить предусмотренный ч. 5 ст. 22 Закона № 44-ФЗ запрос информации о цене товара субъектам деятельности в сфере промышленности, информация о которых включена в государственную информационную систему промышленности.

Постановлением также утверждены положение о требованиях к содержанию и форме отчета об объеме закупок российских товаров в целях достижения заказчиком минимальной обязательной доли закупок, о требованиях к содержанию обоснования невозможности достижения заказчиком минимальной обязательной доли закупок российских товаров, а также положение о порядке, критериях и последствии проведения оценки выполнения заказчиком обязанности достижения минимальной обязательной доли закупок российских товаров.
Минпромторг России определен в качестве уполномоченного органа на осуществление оценки достижения заказчиком минимальной доли закупок.
Постановление Правительства РФ вступит в силу с 1 января 2021 года, за исключением положений о подготовке отчета об объеме закупок российских товаров, осуществленных для достижения заказчиком минимальной доли закупок, обоснования невозможности достижения заказчиком минимальной доли закупок, которые подлежат применению заказчиком с 1 января 2022 года.
