Минэкономразвития России утвердил форму, а также порядок заполнения и подачи заявления о признании гражданина банкротом во внесудебном порядке (приказ Минэкономразвития России от 4 августа 2020 г. № 497). Документ вступает в силу с 1 сентября 2020 года.
Напомним, что воспользоваться таким порядком могут граждане-должники, чей долг составляет от 50 тыс. до 500 тыс. руб. и который они не в состоянии погасить по причине отсутствия имущества (п. 1 ст. 223.2 Федерального закона от 26 октября 2002 г. № 127-ФЗ, далее Закон № 127-ФЗ). При завершении процедуры внесудебного банкротства гражданина, исключенного из ЕГРИП менее чем за один год до подачи заявления о признании гражданина банкротом во внесудебном порядке, применяются последствия признания индивидуального предпринимателя банкротом, предусмотренные ст. 216 Закона № 127-ФЗ.
Форма заявления заполняется либо вручную, либо в машинописном виде без исправлений, выполненных с помощью корректирующего или иного аналогичного средства. Оно должно быть распечатано на бумажном носителе с одной стороны листа и в случае скрепления листов заявления способ скрепления должен обеспечивать сохранность бумажного носителя.

Подать заявление гражданин может лично или через представителя по месту жительства или месту своего пребывания в МФЦ.
