Правительство РФ утвердило правила функционирования государственной интегрированной информационной системы (далее – система) государственного контроля по маркировке драгоценных металлов, камней и изделий из них (постановление Правительства РФ от 26 февраля 2021 г. № 270). Правила не распространяются на Банк России и кредитные организации. Они будут действовать до 1 марта 2027 года.
Основными функциями системы являются сбор, хранение, обработка и предоставление информации о происхождении и обращении драгоценных металлов, камней и изделий из них, организация специального учета участников рынка. Предполагается, что с началом использования системы рынок драгметаллов, камней, ювелирных изделий станет прозрачным в связи с переходом бизнес-процессов в данной сфере в цифровой формат.
Предусматривается поэтапное подключение участников рынка к системе (напомним, ранее планировалось, что в обязательном порядке маркировать ювелирные изделия нужно будет с 1 января 2021 года). Так, например, с 1 марта 2021 года открывается доступ к добровольной регистрации в системе: для постановки на специальный учет, участники должны подать заявление в Федеральную пробирную палату. После постановки на специальный учет пользователи могут перерегистрировать карточку спецучета в системе, а также подать заявление на регистрацию именников изготовителя.
С 1 апреля 2021 года будет осуществляться добровольное:
внесение в систему сведений о ювелирных и других изделиях из драгметаллов и (или) камней отечественного производства, а также ввезенных в РФ из государств, не входящих в ЕАЭС и перемещенных на территорию РФ из государств — членов ЕАЭС, представляемых на опробование, анализ и клеймение государственным пробирным клеймом; внесение сведений о получении заклейменных ювелирных и других изделий из драгметаллов и камней от Федеральной пробирной палаты; нанесение двухмерного штрихового кода непосредственно на ювелирные и другие изделия из драгметаллов и (или) камней; внесение сведений о реализации аффинированных драгоценных металлов в виде стандартных и мерных слитков организациями, имеющими право осуществлять аффинаж драгметаллов; нанесение двухмерного штрихового кода и уникального идентификационного номера организациями, имеющими право осуществлять аффинаж драгоценных металлов, на документ о качестве слитка, сертификат изготовителя аффинированных драгметаллов, оформленные в соответствии с законом РФ; внесение сведений о находящихся в обороте ювелирных и других изделиях из драгметаллов, камней (за исключением принятых на комиссию от граждан, реализуемых ломбардами невостребованных ювелирных и других изделий, на которые обращено взыскание, драгметаллов и драгоценных камней, находящихся в Банке России и кредитных организациях).

В целом продажа немаркированных изделий будет запрещена с 2024 года. Для подключения к системе компаниям необходимо получить электронный ключ и сертификат квалифицированной электронной подписи. Правилами предусмотрены порядок подключения к системе, регистрации продукции, требования к средствам идентификации, способам нанесения маркировки, к самой системе и т. д.
Минфин России сообщил1, что ответы на вопросы бизнеса уже доступны на сайте https://dmdk.ru/. Данный портал будет содержать всю необходимую информацию для участников рынка. Кроме того, открыта «горячая линия», вопросы о функционировании системы можно будет задать по тел: +7(495) 665-45-01 (с 00:00 до 18:00 МСК) и электронной почте: dmdk@goznak.ru
