Отмечается1, что с 2021 года саморегулируемые организации будут собирать и анализировать отчетность малых микрофинансовых институтов, информировать Банк России о выявленных нарушениях для принятия решения о выводе конкретной компании с рынка. Напомним, согласно действующему законодательству Банк России осуществляет регулирование деятельности МФО, а также надзор за соблюдением МФО требований закона и иных нормативных правовых актов (ч. 2 ст. 14 Федерального закона от 2 июля 2010 г. № 151-ФЗ «О микрофинансовой деятельности и микрофинансовых организациях», далее – Закон № 151-ФЗ).
На заседании Экспертного совета по микрофинансированию и кредитной кооперации участники также пришли к мнению, что под непосредственным надзором Банка России останутся МФО, крупные микрокредитные компании и кредитные потребительские кооперативы. Сообщается, что регулятор проводит специальное обучение СРО микрофинансовых организаций, КПК и сельскохозяйственных кредитных потребительских кооперативов для передачи надзорного опыта. Программа такого обучения рассчитана до июля 2021 года.
В указанном разделении полномочий Банк России усматривает плюсы, которые исключат дублирование запросов, мер воздействия, что снизит нагрузку. Кроме того, СРО смогут гибко реагировать на появление новых недобросовестных практик через внесение изменений во внутренние стандарты СРО.

В то же время сегодня в Госдуму поступил законопроект, которым предлагается2 с 1 января будущего года признать утратившим силу Закон № 151-ФЗ, регулирующий деятельность МФО. «Несмотря на то, что микрофинансовые организации – общемировая практика, в настоящее время в России не представляется возможным развивать данный институт финансового рынка, поскольку это приводит к катастрофически быстрому росту долгов населения и резкому снижению уровня жизни, несмотря на принятые ранее ограничения законодательного характера в данной сфере», – следует из пояснительной записки к законопроекту.
Авторы документа полагают, что отмена указанного закона исключит «ростовщичество» в практике работы кредитных организаций, защитит малообеспеченные слои населения от «соблазнов», рекламируемых МФО, косвенно повлияет на уменьшение преступности. При этом отмечается, что при улучшении экономической ситуации в стране, не исключено принятие нового и более продуманного закона о данном виде финансовой деятельности.
