Подписанный Президентом РФ Федеральный конституционный закон о Правительстве РФ вступает в силу с сегодняшнего дня. Документ регулирует статус высшего органа исполнительной власти, определяет организационно-правовые основы его формирования и деятельности (Федеральный конституционный закон от 6 ноября 2020 г. № № 4-ФКЗ, далее – Закон № 4-ФКЗ). Необходимость его принятия обусловлена Законом РФ о поправке к Конституции Российской Федерации от 14 марта 2020 г. № 1-ФКЗ «О совершенствовании регулирования отдельных вопросов организации и функционирования публичной власти».
В частности, Закон № 4-ФКЗ устанавливает, что Правительство РФ обеспечивает проведение единой социально ориентированной государственной политики в области культуры, науки, образования, здравоохранения, социального обеспечения, поддержки, укрепления и защиты семьи, сохранения традиционных семейных ценностей, а также в области охраны окружающей среды. Общее руководство Правительством РФ осуществляет Президент РФ.

Утвержден новый порядок назначения на должность членов Правительства РФ, которым в этой части усилены роли палат Федерального Собрания РФ. Так, Председатель Правительства РФ, его заместители теперь назначаются на должность Президентом РФ после утверждения их кандидатур Госдумой. Предусмотрена соответствующая процедура согласования кандидатур. Напомним, ранее премьер-министр РФ назначался и освобождался от должности Президентом РФ, а заместители назначались на должность Президентом РФ по предложению премьер-министра РФ, в таком же порядке назначались главы министерств (ст. 7–ст. 9 Федерального конституционного закона от 17 декабря 1997 г. № 2-ФКЗ).
Согласно новому закону федеральные министры по вопросам безопасности, обороны, внутренних, иностранных дел, по делам ЧС назначаются Президентом РФ после консультаций с Советом Федерации, а иные министры – после утверждения их кандидатур Госдумой. Законом предусматривается порядок освобождения от должности членов Правительства РФ, прекращения полномочий Правительства РФ, в том числе в связи с выражением Госдумой недоверия Правительству РФ.
Также закрепляются полномочия Правительства РФ в сферах соцобеспечения, защиты семьи и детства, здравоохранения, взаимодействия с институтами гражданского общества и других областях.
