Вчера Президент РФ подписал закон, вносящий масштабные поправки в налоговое законодательство (Федеральный закон от 23 ноября 2020 г. № 374-ФЗ). Поправки касаются реализации отдельных положений основных направлений бюджетной, налоговой и таможенно-тарифной политики РФ, а также на совершенствование некоторых налоговых норм.
Так, в частности, устанавливается право налоговых инспекций обращаться в суд для взыскания с физлиц, не являющихся предпринимателями неуплаченных сумм налогов, сборов, страховых взносов, пеней и штрафов, если налоговые долги превысят 10 тыс. руб. Напомним, что ранее налоговая служба могла обратиться в суд уже при задолженности в 3 тыс. руб.
Также были внесены изменения и в порядок применения нулевой ставки по НДС. Ее применять смогут те налогоплательщики, которые реализуют иностранным покупателям товары в виде водных биологических ресурсов, добытых в исключительной экономической зоне РФ и (или) произведенные из них товаров. При этом устанавливается, что местом реализации данных товаров будет признаваться территория РФ, если в момент начала отгрузки и транспортировки эти товары находятся в исключительной экономической зоне РФ.
Для плательщиков акцизов устанавливается обязанность опубликовывать сведения о свидетельствах о регистрации организации, совершающей операции с этиловым спиртом (операции с денатурированным этиловым спиртом) в электронно-цифровой форме в информационной системе общего пользования ФНС России.

Скорректирован и порядок применения нулевой ставки по налогу на прибыль. Так, исключается норма, позволяющая обходить запрет на применение нулевой ставки к прибыли от реализации акций компаний, активы которых более чем на 50% представлены недвижимостью в РФ.
Помимо этого, субъекты РФ наделяются правом устанавливать инвестиционный налоговый вычет в отношении расходов на научно-исследовательские работы с целью предоставления регионам дополнительных возможностей по стимулированию инновационной деятельности.
