Суть дела сводилась к оспариванию абз. 3 п. 4.3 ПДД, предусматривающего возможность при отсутствии в зоне видимости перехода или перекрестка переходить дорогу под прямым углом к краю проезжей части на участках без разделительной полосы и ограждений (при условии, что дорога хорошо просматривается в обе стороны). Заявитель, оштрафованный на 500 руб. за переход дороги в неположенном месте при наличии рядом пешеходного перехода, посчитал, что данная норма содержат трудновыполнимые и обременительные требования, а также юридико-лингвистическую неопределенность.

В исковом заявлении подчеркивалось, что в действующем законодательстве отсутствует легальное определение понятия «зона видимости» пешеходного перехода, и инспекторы Госавтоинспекции оценивают ее по своему усмотрению. Это, по мнению заявителя, позволяет считать такое понятие категорией оценочного характера.
Постановление о привлечении к административной ответственности в виде штрафа было обжаловано в административном и судебном порядке, однако суды в целом признали правомерным применение санкции по ч. 1 ст. 12.29 КоАП за допущенное нарушение, указав только, что в данном случае было достаточно предупреждения, а не штрафа. Тогда истец обратился в ВС РФ, который также в своем решении от 10 апреля 2019 г. № АКПИ19-19 признал абз. 3 п. 4.3 ПДД не противоречащим действующему законодательству. Суд подчеркнул, что содержащееся в оспариваемой норме правовое регулирование соответствует действующему законодательству в области обеспечения безопасности и организации дорожного движения и не может рассматриваться как нарушающее права административного истца.
Однако заявителя не удовлетворило такое решение и он подал апелляцию. Вчера прошло слушание по делу, в результате которого Апелляционная коллегия ВС РФ оставила без изменения ранее вынесенное ВС РФ решение. Соответствующая информация сегодня появилась в электронной справочной на сайте ВС РФ.
Таким образом, Суд еще раз призвал всех пешеходов соблюдать установленные в ПДД правила перехода дороги – в частности, переходить проезжую часть только по специально оборудованным пешеходным переходам при их наличии в зоне видимости.
