Сегодня на официальном интернет-портале правовой информации был опубликован Федеральный закон от 2 декабря 2019 года № 393-ФЗ «О внесении изменений в Трудовой кодекс РФ по вопросам принудительного исполнения обязанности работодателя по выплате заработной платы и иных сумм, причитающихся работнику».
В этой связи предусматриваются новые полномочия федеральной инспекции труда по профилактике нарушений трудового законодательства и принятию мер по принудительному исполнению работодателем обязанности по выплате не выплаченных работнику зарплаты и (или) других выплат в рамках трудовых отношений. Кроме того, государственные инспекторы труда наделяются правами принимать решения о принудительном исполнении работодателем обязанности по выплате зарплаты или иных выплат работнику.
Порядок исполнения данной обязанности работодателем предусмотрен введенной ст. 360.1 Трудового кодекса и предполагает внесудебную процедуру, в случае обращения работника в соответствующую инспекцию труда.
В частности, если работодатель не выполнил предписание госинспектора труда по выплате зарплаты работнику в срок, установленный таким предписанием, инспектор по истечении этого срока может принять решение о принудительном исполнении работодателем этой обязанности, но не позже одного месяца после истечения данного срока или вступления в законную силу судебного решения о признании предписания законным, если оно было обжаловано работодателем.
Решение госинспектора по труду о принудительном исполнении приравнено законом к исполнительному документу, который должен быть оформлен в порядке, предусмотренном законодательством об исполнительном производстве. Решение подлежит направлению в адрес работодателя в течение трех рабочих дней после принятия по почте заказным письмом с уведомлением либо в виде электронного документа, подписанного усиленной квалифицированной электронной подписью. В течение 10 дней со дня получения работодатель может обжаловать указанное решение.
В случае неисполнения решения госинспектора и истечения срока его обжалования, оно в виде электронного документа должно быть направлено на исполнение в органы Федеральной службы судебных приставов.
Действие новой статьи 360.1 Трудового кодекса РФ не распространяется на отношения работодателей и работников, предусмотренных ч. 4 ст. 349.4 Трудового кодекса РФ.
Соответствующий закон вступит в силу 13 декабря.
