Главный банк страны рассказал, что в ходе поведенческого надзора выявил недобросовестные практики, которые применяются некоторыми банками и микрофинансовыми организациями по отношению к должникам. Такие кредиторы помимо собственно неустойки начисляют иные платежи за просрочку оплаты долга на разовой или периодической основе. При этом суммарный размер ответственности должника, как правило, превышает ограничения по величине неустойки, установленные законом.
Напомним, общий размер штрафных санкций по потребительскому кредиту не может превышать:
20% годовых, если в период просрочки на сумму займа начисляются проценты; 0,1% от суммы просроченной задолженности, если такие проценты не начисляются (ч. 21 ст. 5 Федерального закона от 21 декабря 2013 г. № 353-ФЗ «О потребительском кредите (займе)»).
И в том, и в другом случае, подчеркнул Банк России, такой платеж рассчитывается только от суммы просроченного долга и процентов, а не от всей оставшейся суммы кредита или займа.

Банк также напомнил, что выплата неустойки при нарушении должником своих обязательств должна быть обозначена в кредитном договоре или договоре займа и зафиксирована в 12-й строке таблицы с индивидуальными условиями договора.
