Об этом рассказал вчера руководитель Росреестра Олег Скуфинский на встрече с Председателем Правительства Михаилом Мишустиным. По его словам, законопроект, который можно назвать «Дачная амнистия 2.0», был внесен в Правительство РФ в конце июня. Он направлен на решение нескольких задач.
Во-первых, граждане, владеющие землей на правах пожизненного наследуемого владения или постоянного бессрочного пользования, смогут оформить на нее право собственности. Услуга будет бесплатной.
Напомним, с 29 октября 2001 года, когда был введен в действие Земельный кодекс РФ, земельные участки на этих правах гражданам больше не предоставляются. Но если кто-то получил такое право на землю до указанной даты, оно сохраняется (п. 1 ст. 3 Федерального закона от 25 октября 2001 г. № 137-ФЗ «О введении в действие Земельного кодекса Российской Федерации»). Правда, такие участки фактически исключены из гражданского оборота. В результате новой дачной амнистии граждане смогут продавать их, покупать и в целом распоряжаться без ограничений.

Во-вторых, предполагается отменить уведомительный порядок оформления прав на землю и на объекты капитального строительства. Останется только декларативный порядок, более простой и быстрый.
В-третьих, Дачная амнистия 2.0 поможет в случае, если права на земельный участок возникли до 1998 года, и его границы не оформлены. «И человеку сегодня надо ходить в суды и доказывать, что ты владеешь землей в существующих границах 15 лет. Мы это бремя доказательства в законопроекте исключаем для граждан. И, по сути, права на такие объекты смогут быть оформлены по забору – по факту фактического использования», – рассказал Олег Скуфинский.
В-четвертых, будет проще оформить права на земельные участки при многоквартирных домах. Напомним, если такой участок не сформирован, любой собственник помещения в многоквартирном доме может обратиться в государственные или местные органы с заявлением об образовании земельного участка. Последние, в свою очередь, готовят межевой план и обеспечивают кадастровый учет нового участка (ч. 3, ч. 4 ст. 16 Федерального закона от 29 декабря 2004 г. № 189-ФЗ «О введении в действие Жилищного кодекса Российской Федерации»).
Проблема в том, что стоимость проекта межевания для этих целей составляет более миллиона рублей, и таких средств часто в бюджете нет. Законопроект предлагает оформлять права на придомовую территорию на основе более простого документа – схемы размещения земельного участка. Услуги кадастрового инженера обойдутся в этом случае примерно в 15 тыс. руб.
