Сегодня, 16 марта Конституционный Суд Российской Федерации вынес положительное заключение по запросу Президента РФ о соответствии положений Закона РФ о поправке к Конституции Российской Федерации от 14 марта 2020 г. № 1-ФКЗ «О совершенствовании регулирования отдельных вопросов организации и функционирования публичной власти» (далее – Закон № 1-ФКЗ) Конституции РФ. КС РФ признал1, что порядок вступления в силу ст. 1 Закона № 1-ФКЗ соответствует Конституции РФ, а не вступившие в силу положения Закона № 1-ФКЗ КС РФ соответствуют положениям ее глав 1, 2 и 9.
Заключение незамедлительно направлено Президенту РФ. Данное решение КС РФ окончательно, обжалованию не подлежит и вступает в силу немедленно после его официального опубликования. Заключение «действует непосредственно и не требует подтверждения другими органами и должностными лицами».
Напомним, в субботу, 14 марта Президент РФ Владимир Путин обратился в КС РФ с запросом о конституционности положений Закона № 1-ФКЗ о поправках к Конституции РФ. Подробнее о принятых изменениях к Основному закону страны портал ГАРАНТ.РУ писал ранее.
Теперь, следуя положениям принятого и одобренного Закона № 1-ФКЗ, вступает в силу его ст. 2 о проведении общероссийского голосования, конкретная дата которого должна быть назначена соответствующим Указом Президента РФ.
