Речь идет о поправках в Трудовой кодекс, Федеральный закон от 1 апреля 1996 г. № 27-ФЗ «Об индивидуальном (персонифицированном) учете в системе обязательного пенсионного страхования» и КоАП, направленных на цифровизацию трудовых отношений.
Так, первым законопроектом предусмотрена возможность ведения сведений о трудовой деятельности работника в электронном виде. Имеются в виду сведения о самом работнике, выполняемой им работе, переводах на другую постоянную работу и об увольнении, а также об основаниях прекращения трудового договора. Согласно предлагаемым изменениям с 1 января 2021 года для лиц, впервые поступающих на работу, все сведения будут формироваться в электронном виде без оформления бумажной трудовой книжки. Однако работники не будут лишены права на оформление им бумажных трудовых книжек, если до конца 2020 года подадут об этом письменное заявление. При этом получить сведения о трудовой деятельности (на бумажном носителе или в электронной форме) граждане смогут не только у работодателя по последнему месту работы, но и в МФЦ, ПФР и на Едином портале госуслуг.
Вторая инициатива касается установления с 1 января 2020 года обязанности работодателя (страхователя) представлять в информационную систему ПФР сведения о трудовой деятельности застрахованных лиц. Для этого в индивидуальном лицевом счете появится соответствующий раздел, в котором будут отражаться сведения о месте работы, выполняемой работе и ее периодах (включая данные о переводах на другую работу, об увольнении и основаниях прекращения трудового договора и т. п.). Предполагается, что сведения о трудовой деятельности работодатели должны будут представлять ежемесячно до 15-го числа месяца, следующего за отчетным. А начиная с 1 января 2021 года в случаях приема на работу или увольнения – не позднее рабочего дня, следующего за днем издания документа, являющегося основанием для приема на работу или увольнения.
Наконец, третьим документом вводится административная ответственность для должностных лиц за неоднократное (два и более раза) в течение года нарушение сроков представления необходимых сведений либо представление неполных или недостоверных сведений о трудовой деятельности работника.
Законопроекты будут рассмотрены на заседании Правительства РФ. Ожидается, что их принятие обеспечит не только удобный и быстрый доступ к получению и предоставлению информации о трудовой деятельности, дополнительные возможности трудоустройства для дистанционных работников, но и сохранность персональных данных в информационной системе ПФР. Также поправки избавят работодателей от издержек на приобретение, ведение и хранение бумажных трудовых книжек. По экспертным оценкам, предлагаемые изменения затронут около 60 млн работников и 8,4 млн хозяйствующих субъектов.
