Правительственный документ, подготовленный Минюстом России, вчера внесен в Госдуму. Он направлен на установление правовых, организационных и финансово-экономических основ прохождения нового вида государственной службы – службы в органах принудительного исполнения.
Необходимость введения нового вида службы разработчики обосновывают тем, что в настоящее время ФССП России отнесена к системе федеральных органов исполнительной власти, в которых предусмотрено прохождение только федеральной государственной гражданской службы. Однако, поскольку на должностных лиц службы возложены и государственно-властные полномочия (в т. ч. свойственные правоохранительным органам), то требуется отнесение службы в ФССП России к государственной службе иного вида.
Так, документом1 установлены:
порядок поступления граждан РФ на службу в органы принудительного исполнения РФ; особенности прохождения службы; процедура присвоения специальных званий; классификация должностей в органах принудительного исполнения на должности высшего, старшего, среднего и младшего начальствующего состава; общие квалификационные требования к должностям службы; основные права и обязанности сотрудников; ограничения и запреты, связанные со службой; требования к служебному поведению.
Кроме того, документ затрагивает вопросы служебного времени и времени отдыха сотрудников, определяет условия установления им ненормированного служебного дня. Также он закрепляет единый подход к установлению продолжительности отпусков на службе в органах принудительного исполнения – продолжительность отпуска ставится в зависимость от выслуги лет и от условий прохождения службы. Часть норм касается правил применения к сотрудникам мер поощрения, вопросов соблюдения служебной дисциплины, наложения дисциплинарных взысканий и организации служебных проверок.

Законопроект предусматривает обязательность служебных отношений на контрактной основе. В связи с этим вводится понятие «контракт», определяются его стороны, содержание, порядок заключения, формы и сроки действия, исчерпывающий перечень оснований для прекращения или расторжения. Также прописан конкурсный порядок отбора кандидатур на замещение отдельных должностей, возможность ротации руководителей, порядок урегулирования конфликта интересов, вопросы рассмотрения индивидуальных служебных споров и т. п.
В случае одобрения закона он начнет действовать с 1 января 2020 года. Ожидается, что его принятие позволит создать условия для привлечения в ФССП России высококвалифицированных специалистов, а также мотивировать должностных лиц к качественному исполнению возложенных на них полномочий.
