Проект правил разработан в целях обеспечения граждан жильем в соответствии с ч. 5 ст. 16.5 Федерального закона от 24 июля 2008 года № 161-ФЗ «О содействии развитию жилищного строительства» и установленным перечнем граждан, которые могут быть приняты в члены ЖСК, создаваемых в указанных целях (утв. Постановлением Правительства РФ от 9 февраля 2012 года № 108).
Так, правила будут устанавливать, что список граждан, которые могут быть приняты в члены ЖСК, формируется специально созданной Минюстом России комиссией, в состав которой должны будут входить не менее семи членов. Решения комиссии будут правомочны, если в них примут участие не менее 2/3 от общего числа членов. Порядок принятия граждан в члены ЖСК носит заявительный характер.
По итогу заседания комиссия будет принимать одно из двух решений: включить в списки или отказать во включении кандидата в списки граждан, которые могут быть приняты в члены ЖСК. Такое решение должно быть принято в срок, который не превышает 30 рабочих дней с даты проведения заседания, при условии предоставления кандидатом всех необходимых документов и сведений.
Пакет предоставляемых гражданином в Минюст России документов должен содержать:
копию паспорта гражданина РФ;копию паспорта супруга (супруги) в установленных п. 7-8 перечня граждан, которые могут быть приняты в члены ЖСК, случаях;копия свидетельства о заключении брака и свидетельства о рождении ребенка в установленных п. 7-8 перечня граждан, которые могут быть приняты в члены ЖСК, случаях;копия трудовой книжки в соответствии со ст. 66.1 ТК РФ;выписка из ЕГРН о правах на объекты недвижимости в РФ;копии документов, подтверждающие принятие гражданина на учет в качестве нуждающегося в жилом помещении или для получения единовременной субсидии на приобретение жилого помещения.
Копии указанных документов должны быть нотариально удостоверены. В противном случае вместе с копиями необходимо предъявить их оригиналы.
Проект документа представлен на общественное обсуждение 24 мая. Антикоррупционная экспертиза и общественное обсуждение проекта правил, размещенного на федеральном портале проектов нормативных правовых актов, завершатся 7 июня.
