Федеральным законом от 6 февраля 2020 г. № 15-ФЗ внесены изменения в Федеральный закон от 17 января 1992 г. № 2202-I «О прокуратуре Российской Федерации» (далее – Закон о прокуратуре), конкретизирующие требования к уровню образования кандидатов в прокуроры, а также особенности подготовки прокурорских кадров. Так, ранее в п. 1 ст. 40.1 Закона о прокуратуре к лицам, претендующим на должности прокуроров, предъявлялись требования к наличию высшего юридического образования без определения его уровня.
Новая редакция данного пункта предусматривает в этой части условие, по которому прокурорами могут быть граждане РФ, получившие высшее юридическое образование по специальности «Юриспруденция» или по направлению подготовки «Юриспруденция» квалификации «магистр» при наличии диплома бакалавра по этому же направлению, либо высшее образование по специальностям, входящим в укрупненную группу специальностей «Юриспруденция», с присвоением квалификации «юрист». При этом новым законом оговорено, что граждан, уже имеющих бакалавриат по направлению «юриспруденция» в рамках ранее заключенных договоров о целевом обучении в целях дальнейшего трудоустройства в органах прокуратуры, данные требования к уровню высшего образования не коснутся.
В ст. 43.5 Закона о прокуратуре предусматриваются дополнения о том, что особенности заключения договора о целевом обучении с обязательством прохождения службы в органах и организациях прокуратуры теперь будут определяться Генеральным прокурором РФ. Также прописывается, что в случае неисполнения обязательств по таким целевым договорам лицами, обучающимися или уже получившими высшее образование, они должны нести ответственность в соответствии с законодательством РФ.
Изменения в закон обусловлены необходимостью обеспечения единого подхода к решению кадровых вопросов в системе государственной службы РФ, совершенствования порядка поступления на службу и подготовки кадров в системе органов прокуратуры. Поправки вступят в силу по истечении 10 дней после дня официального опубликования закона, то есть 17 февраля.
