Весной следующего года будут официально введены в оборот термины «открытый» и «закрытый» способы взимания платы. В первом случае речь пойдет о регистрации факта проезда и оплате проезда непосредственно при проезде через расположенный на платной трассе пункт взимания платы. При применении данного способа размер оплаты будет рассчитываться независимо от места въезда пользователя на автодорогу или съезда с нее. Во втором случае все наоборот: регистрация места въезда на трассу будет осуществляться на пункте выдачи талонов, а сумма оплаты – определена с учетом пройденного водителем расстояния. О данных нововведениях говорится в Постановлении Правительства РФ от 30 сентября 2021 г. № 1652 «Об утверждении Правил взимания платы за проезд по платным автомобильным дорогам общего пользования федерального значения и платным участкам таких автомобильных дорог», подписанном Председателем Правительства РФ Михаилом Мишустиным.
Помимо этого, документ конкретизирует порядок взаимодействия пользователя с оператором, права и обязанности сторон, закрепляет «постоплатный» и «предоплатный» способы оплаты проезда, а также определяет две системы взимания платы: барьерного типа и «свободный поток», которые выделяются в зависимости от наличия или отсутствия шлагбаумов на трассах. Нововведения вступят в силу 1 марта 2022 года и будут действовать до 1 марта 2028 года.
На настоящий момент действуют правила, утвержденные Постановлением Правительства РФ от 19 января 2010 г. № 18, согласно которым плата за проезд взимается на соответствующих пунктах, за исключением случаев предварительной оплаты проезда. При этом предусмотрена дифференциация ее размера в зависимости от времени суток, дня недели или месяца года, но от пройденного пользователем расстояния она не зависит.
Напомним, что необходимость обновления порядка оказания услуг по организации проезда по платным дорогам вызвана принятием Федерального закона от 15 октября 2020 г. № 326-ФЗ «О внесении изменений в статьи 29 и 40 Федерального закона «Об автомобильных дорогах и о дорожной деятельности в Российской Федерации и о внесении изменений в отдельные законодательные акты Российской Федерации», предусмотревшим введение новых правил.
