Правительство РФ утвердило положение об особенностях исполнения договоров воздушной перевозки пассажиров в 2020 году (Постановление Правительства РФ от 6 июля 2020 г. № 991). Документ предусматривает, в частности, порядок и сроки возврата стоимости авиабилета в условиях режима ЧС или повышенной готовности на территории РФ (ее части), повлекших ограничение международного или внутреннего сообщения.
Утвержденное положение применимо к договорам, которые должны были исполняться с 1 февраля по международным перевозкам с Китаем и с 18 марта – по всем внутренним и международным воздушным перевозкам, заключенным до 1 мая 2020 года. Правила не подлежат применению к договорам чартерных авиаперевозок.
Согласно положению перевозчик вправе возвратить стоимость билета по прошествии 3 лет с даты отправления рейса. На уплаченную сумму билета до дня возврата суммы, но не позднее 4-летнего срока с даты отправления рейса подлежат начислению проценты в размере, определяемом ключевой ставкой Банка России. Пассажир по истечении 3 лет с даты отправления рейса должен направить на сайт перевозчика заявление о возврате денег за билет. Для отдельных категорий граждан (ветеранов Великой Отечественной войны, инвалидов I, II групп (а также сопровождающих их лиц), членов многодетных семей) при подтверждении соответствующего статуса предусмотрена возможность возврата стоимости билетов до указанного срока. В течение 10 календарных дней со дня получения заявления о возврате стоимости билета перевозчик обязан возвратить деньги на банковскую карту пассажира, с которой был осуществлен платеж. Деньги могут быть возвращены и на иную банковскую карту, однако в этом случае заявление следует подавать лично в пункты, определенные правилами перевозчика.

Также предусмотрена возможность принятия стоимости оплаченного билета в качестве платы за иную авиаперевозку в течение 3 лет с даты отправления рейса. При этом пассажир может использовать и часть суммы от стоимости билета, а в случае ее недостаточности доплатить за новый билет. Проценты на сумму оплаченного билета в этом случае не выплачиваются. Ограничения по маршруту или датам отправления (при наличии в продаже билетов) не допускаются. Пассажир должен направить уведомление на сайт перевозчика о желании воспользоваться оплатой билета в счет оплаты услуг перевозки указанным способом до даты отправления (перевозчик обязан за 20 календарных дней подтвердить принятие стоимости оплаченного билета в счет оплаты нового билета) или в течение 3 лет с даты отправления рейса, указанного в билете.
Соответствующее Постановление Правительства РФ вступило в силу 7 июля.
