Сегодня депутат Александр Старовойтов внес в Госдуму законопроект, предусматривающий дополнение Уголовного кодекса новой статьей 286.2 «Оскорбление, совершенное должностным лицом».
Речь идет об оскорблении, совершенном должностным лицом при исполнении им своих служебных обязанностей, в отношении другого лица. За такое деяние планируется ввести уголовную ответственность в виде штрафа в размере 500-800 тыс. руб. или в размере зарплаты или иного дохода осужденного за период от одного года до двух лет с лишением права занимать определенные должности или заниматься определенной деятельностью на срок до трех лет или без такового, либо принудительных работ на срок до двух лет, либо ареста на срок до полугода.
Повышенные санкции (начиная от штрафа в сумме 1-2 млн руб. и заканчивая лишением свободы на срок до года) предусмотрены за то же деяние, совершенное в ходе публичного выступления, публично демонстрирующегося произведения или в СМИ. В случае одобрения инициативы, если преступление совершит лицо, занимающее государственную должность РФ или государственную должность субъекта РФ, а равно глава органа местного самоуправления, ему будут грозить штраф в размере 2-3 млн руб. или в размере зарплаты или иного дохода осужденного за период до пяти лет, либо принудительные работы на срок до пяти лет с лишением права занимать определенные должности или заниматься определенной деятельностью на срок до пяти лет или без такового, либо лишение свободы на срок до двух лет.
Еще более суровые меры ответственности (лишение свободы на срок от трех до пяти лет с лишением права занимать определенные должности или заниматься определенной деятельностью на срок до пяти лет) предлагается ввести за оскорбления, совершенные с применением насилия или с угрозой его применения, с причинением тяжких последствий.
Автор инициативы1 считает несправедливым, что УК РФ предусматривает уголовную ответственность гражданина за оскорбление представителя власти (ст. 319 УК РФ), но не содержит норм об ответственности должностных лиц за оскорбление гражданина. Парламентарий уверен, что предлагаемые им поправки позволят «уравнять» правовое положение субъектов публичной власти и граждан в части сбалансированного действия уголовной ответственности за оскорбительные высказывания, восстановив тем самым социальную справедливость.
