Подготовку специального сервиса анонсировал Президент ФПА РФ Юрий Пилипенко, говоря о наиболее важных для адвокатского сообщества результатах работы органов адвокатского самоуправления в период между заседаниями Совета ФПА РФ. Соответствующая информация появилась на официальном сайте ФПА РФ.
Напомним, в июле текущего года Совет ФПА РФ принял решение обновить тестовые задания для сдачи экзамена на приобретение статуса адвоката и разместить их в открытом доступе для ознакомления всех желающих. Тест содержит 324 задания, часть из которых – с выбором нескольких вариантов из перечня предложенных ответов. Треть вопросов касается норм Федерального закона от 31 мая 2002 г. № 63-ФЗ «Об адвокатской деятельности и адвокатуре в Российской Федерации» (далее – Закон об адвокатуре), остальные – преимущественно положений Кодекса профессиональной этики адвоката. Прием квалификационного экзамена с использованием новой редакции вопросов проводится с 1 сентября.
Что касается тренажера для подготовки к тестированию, то, по мнению Юрия Пилипенко, этот инструмент будет полезен не только претендентам на присвоение статуса адвоката, но и многим действующим адвокатам. С его помощью они закрепят (проверят) свои знания норм Закона об адвокатуре и Кодекса профессиональной этики адвоката.

Напомним, квалификационный экзамен проводится с целью установления наличия у претендента необходимых профессиональных знаний. Он состоит из письменных ответов на вопросы (тестирование – в компьютерной форме) и устного собеседования (п. 1.1 и п. 2.2 Положения о порядке сдачи квалификационного экзамена на присвоение статуса адвоката (утв. Советом ФПА РФ 25 апреля 2003 г., протокол № 2). Именно по итогам сдачи такого экзамена квалификационная комиссия адвокатской палаты субъекта РФ принимает решение о присвоении статуса адвоката (п. 3 ст. 9 Закона об адвокатуре). Лицо, получившее статус адвоката, вправе осуществлять адвокатскую деятельность на всей территории России без какого-либо дополнительного разрешения.
