Председатель Правительства РФ Михаил Мишустин рассказал1 30 июня на заседании кабмина о подготовке соответствующего законопроекта. Так, нуждающиеся в жилье сотрудники МВД России смогут выбирать между единовременной выплатой на жилье или готовой квартирой.
В настоящее время полицейские, которые не имеют собственного жилья, могут претендовать только на социальную выплату для его приобретения. Ее размер рассчитывается с учетом выслуги, звания, количества членов семьи и т. д. Право на выплату возникает при стаже службы не менее 10 лет (ст. 4 Федерального закона от 19 июля 2011 г. № 247-ФЗ «О социальных гарантиях сотрудникам органов внутренних дел Российской Федерации и внесении изменений в отдельные законодательные акты Российской Федерации»; далее – Закон № 247-ФЗ).

Получение собственно квартиры предусмотрено только в том случае, если сотрудник пострадал при несении службы и стал инвалидом I или II группы либо умер. В последнем случае жилье предоставляется членам его семьи (ст. 5 Закона № 247-ФЗ).
Кроме того, согласно законопроекту право на выплату для покупки жилья будет сохранено за теми, кто был уволен со службы по состоянию здоровья или из-за изменений в штате. Сегодня такое право сохраняется только за пенсионерами (п. 6 ст. 4 Закона № 347-ФЗ).
Наконец, третье нововведение: пенсионеры органов внутренних дел, которые отработали не менее 25 лет, смогут продолжать пользоваться служебными квартирами, пока ожидают собственное жилье. Сегодня пользоваться служебными квартирами могут только действующие сотрудники либо члены их семей в случае гибели сотрудника при исполнении (ст. 8 Закона № 347-ФЗ).
