Налоговая служба опубликовала на своем официальном сайте напоминание об истечении сроков предоставления физлицами уведомлений о контролируемых иностранных компаниях за 2020 год (форма, формат и порядок представления уведомления утв. приказом ФНС России от 26 августа 2019 г. № ММВ-7-13/422@). Направить информацию нужно вне зависимости от того, получила ли компания прибыль или убыток. Вместе с уведомлением нужно будет представить документы, подтверждающие размер финансового результата иностранной компании. Не сделано исключений и для компаний, чей доход меньше учитываемой при определении налоговой базы по прибыли (10 млн руб.) ( п. 7 ст. 25.15 Налогового кодекса).

Контролирующим лицом признается то, доля прямого или косвенного участия которого составляет более 25% или доля прямого или косвенного участия составляет более 10%, если доля участия всех лиц, признаваемых налоговыми резидентами РФ, в этой организации составляет более 50%.
Обратите внимание, что даже те физлица, которые не обязаны предоставлять уведомление о КИК, должны до 30 апреля направить в налоговую инспекцию документы, подтверждающие право на освобождение. Исключение сделано только в отношении компаний, образованных в соответствии с законодательством государства – члена Евразийского экономического союза и имеющих постоянное местонахождение в этом государстве.
За непредставление уведомления о КИК, а также подтверждающих документов в установленный срок на налогоплательщика налагается штраф в размере 500 тыс. рублей.
