ФССП России подготовила проект приказа об утверждении Кодекса этики и служебного поведения сотрудников органов принудительного исполнения РФ. Документ опубликован1 на федеральном портале проектов нормативных правовых актов. Отмечается, что знание и соблюдение Кодекса будет являться одним из критериев оценки качества профессиональной деятельности и служебного поведения сотрудников.
Проектом Кодекса определяются нормы служебной этики, основные принципы и требования к служебному поведению сотрудников при осуществлении служебной деятельности, а также вне ее. От сотрудника ФССП России на основании норм проектируемого Кодекса потребуется:
учитывать, что признание, соблюдение и защита прав и свобод человека и гражданина определяют содержание его профессиональной служебной деятельности; заботиться о сохранении своих чести и достоинства, не допускать принятия решений из соображений личной заинтересованности, не совершать при выполнении служебных обязанностей сомнительные поступки, наносящие ущерб его репутации, авторитету органов госвласти; проявлять уважение, вежливость, тактичность по отношению к гражданам, в пределах служебных полномочий оказывать им содействие в реализации их прав и свобод; соблюдать нейтральность, не оказывать предпочтение каким-либо политическим партиям, другим общественным объединениям, религиозным и иным организациям, профессиональным или социальным группам, гражданам; не допускать публичные высказывания, суждения и оценки, в том числе в СМИ в отношении госорганов, должностных лиц, политических партий, других общественных объединений, религиозных и иных организаций, граждан, если это не входит в его служебные обязанности; проявлять уважение к национальным обычаям и традициям и т. д.

Кроме того, сотрудникам ФССП России предписывается противодействовать проявлениям коррупции, быть нетерпимыми к нарушениям законности, служить примером высокого уровня правосознания и дисциплины, воздерживаться от публичного участия в азартных играх, исключать употребление алкоголя накануне и во время выполнения служебных обязанностей. Также потребуется воздерживаться от курения в форме на ходу, в местах, не отведенных для курения, а также во время служебного общения с гражданами.
Проект также содержит раздел о требованиях к внешнему виду и ношению форменной одежды сотрудника ФССП России. Так, форменная одежда должна быть чистой и аккуратной, хорошо подогнанной и отглаженной. Сотруднику не следует держать руки в карманах форменной одежды, ходить в нечищеной и стоптанной обуви, а также в форме, утратившей надлежащий вид. Необходимо соблюдать скромность и разумную достаточность в использовании парфюмерии, косметики и ношении ювелирных украшений. Предусматриваются отдельные этические нормы и требования при обращении со служебной и личной информацией, в частности, в интернете на личных страницах социальных сетей и других ресурсах.
Отдельно прописываются нормы служебной этики и требования к лицам руководящего состава.
Антикоррупционная экспертиза проекта завершится 30 декабря 2020 года, а общественое обсуждение – 7 января 2021 года.
