Вчера вступили в силу поправки в налоговое законодательство, в том числе и в части изменения порядка исчисления авансовых платежей по налогу на прибыль (Федеральный закон от 22 апреля 2020 г. № 121-ФЗ). Так, по новым правилам организация может перейти на порядок исчисления авансовых платежей исходя из фактической прибыли не с 1 января следующего года, как было установлено ранее, а в течение 2020 года (ст. 286 Налогового кодекса). Как поясняет налоговая служба, организации, воспользовавшиеся таким правом, будут исчислять авансовые платежи по налогу на прибыль исходя из ставки налога и фактически полученной прибыли, рассчитанной нарастающим итогом с 1 января 2020 года до окончания соответствующего месяца (информация ФНС России от 22 апреля 2020 г.). Для того, чтобы перейти на такой порядок исчисления авансовых платежей, организация должна заранее уведомить налоговый орган. Сделать это нужно не позднее 20 числа месяца, на который приходится окончание отчетного периода, начиная с которого налогоплательщик переходит на уплату ежемесячных авансовых платежей исходя из фактической прибыли. Т. е. если организация решит перейти на такой порядок начисления авансовых платежей начиная с отчетного периода январь-май, то подать уведомление нужно до 20 мая. При этом в случае перехода на новую систему с отчетного периода «четыре месяца» налогоплательщик обязан уведомить об этом налоговый орган не позднее 8 мая 2020 года.
