Предлагается предусмотреть возможность прохождения обучающимися по основным профессиональным образовательным программам практической подготовки у ИП, а также нотариусов, занимающихся частной практикой, и адвокатов, учредивших адвокатские кабинеты. Соответствующий законопроект1 о внесении изменений в Федеральный закон от 29 декабря 2012 г. № 273-ФЗ «Об образовании в Российской Федерации» (далее – Закон № 273-ФЗ), разработанный Минобрнауки России, размещен на федеральном портале проектов нормативных правовых актов. Общественное обсуждение и антикоррупционная экспертиза законопроекта закончатся 26 ноября.
В пояснительной записке к документу отмечается, что для целого ряда направлений подготовки, реализуемых в интересах реального сектора экономики, ограничения круга мест для прохождения практики не позволяют получить практический опыт во многих отраслях деятельности. Так, например, согласно данным Росстата в России 6 674 946 человек зарегистрированы в качестве ИП.
Напомним, в соответствии с ч. 2 п. 7 ст. 13 Закона № 273-ФЗ практическая подготовка может быть организована:
непосредственно в организации, осуществляющей образовательную деятельность, в том числе в структурном подразделении указанной организации, предназначенном для проведения практической подготовки;в организации, осуществляющей деятельность по профилю соответствующей образовательной программы, в том числе ее структурном подразделении, предназначенном для проведения практической подготовки, на основании договора, заключаемого между указанной организацией и организацией, осуществляющей образовательную деятельность.
При этом согласно ст. 11 Налогового кодекса РФ организациями являются юридические лица, образованные в соответствии с российским законодательством. Таким образом, на сегодняшний день прохождение студентами практики возможно исключительно у юридических лиц.
