Владимир Путин подписал закон об исключении указания на МРОТ из некоторых законов. В частности, в абз. 5 ч. 1 ст. 446 Гражданского процессуального кодекса указание на МРОТ заменено на твердую денежную сумму, когда речь идет об имуществе, которое не подлежит взысканию по исполнительным документам. Так, в предыдущей редакции статьи указывалось, что не может быть изъято имущество, предназначенное для профессиональных занятий гражданина-должника, за исключением предметов, стоимость которых превышает 100 МРОТ. Теперь указание на МРОТ заменено на 10 тыс. руб. (Федеральный закон от 23 ноября 2020 г. № 378-ФЗ).
Помимо этого, исключается упоминание МРОТ из Федеральных законов:
от 8 декабря 1995 г. № 193-ФЗ «О сельскохозяйственной кооперации»; от 14 ноября 2002 г. № 161-ФЗ «О государственных и муниципальных унитарных предприятиях»; от 10 января 2003 г. № 18-ФЗ «Устав железнодорожного транспорта Российской Федерации» от 27 февраля 2003 г. № 29-ФЗ «Об особенностях управления и распоряжения имуществом железнодорожного транспорта».

Необходимость изменений вызвана приведением законодательства в соответствие со ст. 3 Федерального закона от 19 июня 2000 г. № 82-ФЗ «О минимальном размере оплаты труда» (далее – Закон № 82-ФЗ), согласно которой МРОТ применяется для регулирования оплаты труда и определения размеров пособий по временной нетрудоспособности, по беременности и родам, а также для иных целей обязательного социального страхования. Применение МРОТ для других целей не допускается. При этом новый закон также указывает в некоторых законах об исчислении платежей по гражданско-правовым обязательствам в соответствии со ст. 5 Закона № 82-ФЗ, исходя из базовой суммы, равной 100 руб.
Кроме того, вносятся изменения в п. 2 ст. 23 Федерального закона от 14 ноября 2002 г. № 161-ФЗ «О государственных и муниципальных унитарных предприятиях». Согласно поправкам уточняются критерии определения стоимости имущества унитарного предприятия в случаях его отчуждения, возникновения возможности отчуждения или приобретения. Также приводится в соответствие с Федеральным законом от 6 декабря 2011 г. № 402-ФЗ «О бухгалтерском учете» терминология, касающаяся «бухгалтерской (финансовой) отчетности».
