Речь идет об исключении из перечня сведений, которые следует указывать в заявлении при распоряжении средствами маткапитала (его части) на строительство (реконструкцию) дома без привлечения строительной организации при подаче в ПФР, сведений, подтверждающих проведение основных работ по строительству объекта ИЖС (монтаж фундамента, возведение стен и кровли), то есть акта выполненных строительных работ. Соответствующее изменение внесено1 в Правила направления средств (части средств) материнского (семейного) капитала на улучшение жилищных условий, утв. постановлением Правительства РФ от 12 декабря 2007 г. № 862.

Таким образом, направить средства маткапитала на улучшение жилищных условий, а именно, на компенсацию затрат на строительство (реконструкцию) объекта ИЖС в соответствии с п. 10.4 названных правил можно, указав в заявлении следующие сведения:
о зарегистрированном в ЕГРН праве лица, получившего сертификат на маткапитал (его супруга), собственности, постоянного (бессрочного) пользования, пожизненно наследуемого владения, аренды либо безвозмездного пользования в отношении земельного участка, который предназначен для ИЖС или ведения садоводства и на котором построен (реконструирован) жилой дом; о зарегистрированном в ЕГРН праве лица, получившего сертификат, или его супруга на построенный объект ИЖС, возникшем не ранее 1 января 2007 года, либо о зарегистрированном праве на реконструированный после 1 января 2007 года объект ИЖС (независимо от даты возникновения указанного права); из документа, выданного органом, уполномоченным на выдачу разрешения на строительство, подтверждающего проведение работ по реконструкции объекта ИЖС, в результате которых общая площадь жилого помещения (жилых помещений) реконструируемого объекта увеличивается не менее чем на учетную норму площади жилого помещения, устанавливаемую в соответствии с жилищным законодательством РФ; о реквизитах банковского счета лица, получившего сертификат.
Напомним, с 2021 года размер маткапитала составляет 483 882 руб. на первого ребенка и 639 432 руб. – на второго.
