Правительство РФ утвердило соответствующее постановление от 1 октября 2020 г. № 1577, которым определен порядок заключения, изменения, прекращения действия соглашений о защите и поощрении капиталовложений при реализации инвестиционных проектов. Напомним, согласно Федеральному закону от 1 апреля 2020 г. № 69-ФЗ «О защите и поощрении капиталовложений в Российской Федерации» для участия в инвестиционной деятельности заявитель, которым может стать как физлицо, так и юрлицо (группа юрлиц), осуществляющее инвестиционную и (или) хозяйственную деятельность, а также иностранный инвестор, могут направить в уполномоченные органы госвласти субъекта (на территории которого планируется реализация инвестиционного проекта) заявление об участии в таком проекте в порядке частной или публичной проектной инициативы. Инвестиционный проект может быть реализован в одной из сфер экономики, за исключением некоторых видов деятельности, указанных в законе.
Утвержденные Правила устанавливают порядок заключения соглашений в рамках частной проектной инициативы, особенности раскрытия информации о бенефициарных владельцах компании, реализующей проект, порядок ведения реестра заключенных соглашений и т. д. Содержатся требования к заявителю, к содержанию заявления и к проекту.
В частности, соглашение может быть заключено в отношении проекта, который удовлетворяет требованиям, установленным Законом № 69-ФЗ. Например, он должен отвечать признакам инвестиционного проекта, быть ограниченным по времени осуществления и затрачиваемым ресурсам, направленным на создание (строительство) и последующую эксплуатацию новых либо модернизацию и (или) реконструкцию и последующую эксплуатацию существующих объектов недвижимого имущества и (или) комплекса объектов движимого и недвижимого имущества, связанных между собой, и (или) на создание и использование результатов интеллектуальной деятельности и (или) средств индивидуализации в целях извлечения прибыли и (или) достижения иного полезного эффекта, в том числе предотвращения или минимизации негативного влияния на окружающую среду. При этом планируемый заявителем размер капиталовложений в проект должен соответствовать п. 2 – п. 3 ч. 4 ст. 9 Закона № 69-ФЗ, а вложенные денежные средства, в свою очередь, должны отвечать признакам капиталовложений (п. 5 ч. 1 ст. 2 Закона № 69-ФЗ).

Установлены требования к заявлению, которое заявитель должен направить в Минэкономразвития России, и перечень прилагаемых к нему документов: в него входят правоустанавливающие документы заявителя, бизнес-план проекта, включающий его описание, прогнозные данные и подтверждение возможности сформировать капиталовложения.
Правилами устанавливаются также порядок и сроки рассмотрения заявления и ходатайств заявителя о признании ранее заключенного договора связанным. Утверждены также формы заявления о заключении соглашения о защите и поощрении капиталовложений, самого соглашения, предложения о выборе актов, не подлежащих применению в рамках соглашения, и других документов.
