Конституционный Суд Российской Федерации проверил на соответствие Конституции РФ положение абз. 2 ч. 6 ст. 112 Гражданского процессуального кодекса, в части принятия на их основании решений о восстановлении пропущенного срока подачи кассационной жалобы конкурсным кредитором. Соответствующее Постановление Конституционного Суда РФ от 1 июня 2021 года № 25-П опубликовано на официальном сайте Суда 4 июня.
Так, в КС РФ обратился гражданин, который является кредитором должника, в отношении которого было возбуждено дело о банкротстве и введена процедура реструктуризации долгов. Указанное судебное дело было инициировано другим кредитором должника, в пользу которого суд первой инстанции взыскал задолженность по договорам займа.

Согласно материалам дела, кредитор узнал о возбужденном деле о банкротстве спустя год на стадии подачи ходатайства о включении своих требований в реестр, уже после его вступления в силу и истечении сроков на обжалование. Суд общей юрисдикции ему отказал в восстановлении пропущенного срока подачи кассационной жалобы. Основанием для отказа в удовлетворении требований служило истечение годичного срока после вступления в силу обжалуемого судебного постановления, на котором основано заявленное в деле о банкротстве требование. При этом суд не выяснил причины, по которым заявитель узнал или должен был узнать о нарушении его прав и законных интересов обжалуемым судебным постановлением. За защитой своих нарушенных прав и законных интересов кредитор обратился в КС РФ.
Отправляя дело на пересмотр, КС РФ пришел к следующим выводам. «Не предполагают отказа в удовлетворении ходатайства о восстановлении пропущенного срока подачи кассационной жалобы лишь по причине истечения предусмотренного ими предельно допустимого срока подачи соответствующего ходатайства», – отметил Суд. Указанные выводы содержатся в ранних решениях КС РФ (Определении от 16 января 2007 года № 234-О-П, Постановлении от 17 ноября 2005 года № 11-П).
Также Суд указал на принцип равенства реализации конституционного права на судебную защиту, в силу которого однородные по своей юридической природе отношения должны регулироваться одинаковым образом. Так, ч. 2 ст. 276 Арбитражного процессуального кодекса дополнена в 2010 году нормой, позволяющей судам восстанавливать срок подачи кассационной жалобы на решение арбитражного суда. Таким образом, оспоренная норма ГПК РФ не противоречит Конституции РФ, и не содержит препятствий для восстановления пропущенного срока подачи кассационной жалобы, с учетом ее толкования КС РФ, отраженном в ранних постановлениях Суда.
