Это следует из размещенных на официальном сайте кабинета министров положительных отзывов на соответствующие законопроекты. Речь идет о разработанных членом Совета Федерации Андреем Турчаком инициативах, направленных на уточнение правовых норм для создания цифрового профиля граждан и организаций, а также обеспечение условий для дальнейшего развития сферы электронных услуг, торговли и сделок, совершенных в электронной форме.
Так, первым документом планируется внести изменения в федеральные законы от 27 июля 2006 г. № 149-ФЗ «Об информации, информационных технологиях и о защите информации», от 27 июля 2006 г. № 152-ФЗ «О персональных данных», от 7 июля 2003 г. № 126-ФЗ «О связи» и от 21 ноября 2011 г. № 323-ФЗ «Об основах охраны здоровья граждан в Российской Федерации». В частности, предусматривается введение электронных удостоверений личности и создание инфраструктуры цифрового профиля, наполняемого сведениями из государственных и муниципальных информационных систем.
Вторым законопроектом предлагается регламентировать процедуру достоверности идентификации лица с использованием электронного сервиса, обеспечивающего электронное взаимодействие. Для этих целей аккредитованные удостоверяющие центры могут получить полномочия по хранению ключа электронной подписи и подписанию электронных документов по поручению владельца квалифицированного сертификата (технология «облачной электронной подписи»).
Также предполагается усилить требования к порядку аккредитации удостоверяющих центров и деятельности аккредитованных удостоверяющих центров за счет установления высокого порога собственного капитала удостоверяющего центра, высокого порога страховой ответственности деятельности аккредитованного удостоверяющего центра, сокращения срока аккредитации центров до трех лет и наделения отдельных ведомств исключительным правом на выдачу квалифицированных сертификатов юрлицам, включая их руководителей. В числе проектируемых поправок предусмотрено и создание доверенных третьих сторон – федеральных органов или организаций, уполномоченных осуществлять в т. ч. деятельность по проверке электронных подписей в электронных документах в фиксированный момент времени и документального подтверждения результатов такой проверки.
Правительство РФ поддержало указанные законопроекты. Также оно положительно оценило особый порядок вступления в силу отдельных изменений, который будет способствовать осуществлению перехода к новой схеме функционирования аккредитованных удостоверяющих центров, обеспечивая действие уже выданных сертификатов ключей проверки электронных подписей.
