Минпросвещения России предложило внести в Трудовой кодекс изменения, которые касаются приема на работу и уже работающих граждан в организациях, осуществляющих воспитание, обучение и развитие детей-сирот и детей, оставшихся без попечения родителей. Сооответствующий законопроект1размещен на федеральном портале проектов нормативных правовых актов. Его независимая антикоррупционная экспертиза закончится 27 октября.
Так, в новой редакции планируют изложить ст. 351.1 ТК РФ, которая предусматривает, что поступающим лицам на работу в организации для детей-сирот нужно будет проходить психологическое обследование, а уже работающим делать это не реже одного раза в три года.
Помимо этого, будет дополнен список документов, предъявляемых при заключении трудового договора (ст. 65 ТК РФ). В него добавят заключение о прохождении психологического обследования, форму которого установят позднее.
У работодателя появится право отстранить работника от работы до тех пор, пока он не пройдет психологическое обследование. В этот период заработная плата работнику начисляться не будет. Однако это положение не будет распространяться на период, в который работника не допустили к исполнению обязанностей, если психологическое обследование он не прошел не по своей вине. В этом случае оплата ему будет произведена как за простой (ст. 157 ТК РФ).
Если результаты психологического обследования будут содержать рекомендации по недопуску работника к должностным обязанностям, трудовой договор с ним будет прекращен на основании ст. 84 ТК РФ. У работника будет возможность оспорить выводы обследования, но на этот период он будет отстранен от работы.
Как отмечают в пояснительной записке авторы законопроекта, действие вносимых изменений планируется распространить не только на педагогов, но и на работников обслуживающего персонала (к примеру, поваров, водителей, охранников). Ключевыми факторами особого контроля в организациях для детей-сирот является круглосуточное пребывание в них значительного количества детей, в том числе детей-инвалидов, а также их нахождение в постоянном контакте с работниками разных специальностей. Это и определяет возможность установления ограничений в отношении доступа к соответствующей деятельности таких лиц.
Расходы на психологическое обследование в случае принятия закона разработчики оценили в более, чем 40 млн руб. в год, которые предлагают возложить на бюджеты субъектов РФ.
Все организационные мероприятия по механизму проведения психологического обследования (определение порядка, формы проведения) должны быть утверждены уполномоченным на то Правительством РФ органом.
В случае принятия закона, его вступление в силу запланировано с 1 января 2021 года.
