ФНС России подготовлен проект обновленной формы налоговой декларации по НДФЛ (форма 3-НДФЛ), порядка ее заполнения, а также формата представления в электронной форме1. Предполагается, что соответствующий приказ вступит в силу по истечении двух месяцев со дня его официального опубликования, но не ранее 1 января 2022 года, и будет применяться начиная с представления налоговой декларации по налогу за налоговый период 2021 года.
Необходимость корректировки действующей формы обусловлена внесением изменений в налоговое законодательство, вступивших в силу с 1 января 2021 года, в части увеличение налоговой ставки по НДФЛ с доходов физлиц, превышающих 5 млн руб. за налоговый период (Федеральный закон от 23 ноября 2020 г. № 372-ФЗ). Также были внесены поправки предусматривающие возможность налогоплательщикам получать налоговые вычеты по НДФЛ в упрощенном порядке (Федеральный закон от 20 апреля 2021 г. № 100-ФЗ). Напомним, что речь идет об инвестиционном вычете, а также имущественных вычетах по расходам на приобретение объектов недвижимости (ст. 221.1 Налогового кодекса).

Декларацию, как и прежде, можно будет заполнить как на бумажном носителе от руки либо распечатать на принтере, так и с использованием программного обеспечения, предусматривающего при распечатывании вывод на страницах двумерного штрих-кода. При этом двусторонняя печать декларации на бумажном носителе не допускается.
