В Едином государственном реестре юридических лиц дополнительно появятся сведения о возбуждении производства по делу о банкротстве юрлица и о проводимых в отношении него процедурах, применяемых в деле о банкротстве. Имеется в виду информация о:
возбуждении в отношении организации дела о банкротстве;введении наблюдения, финансового оздоровления, внешнего управления;дате начала соответствующей процедуры, прекращении производства по делу о банкротстве;назначенном внешнем управляющем.
Отмечается, что ранее в ЕГРЮЛ отражались только данные об открытии конкурсного производства и назначенном конкурсном управляющем. Новые сведения будут вноситься в ЕГРЮЛ автоматически – на основании информации, представленной в ФНС России в электронной форме оператором Единого федерального реестра сведений о банкротстве.
Напомним, в ЕГРЮЛ содержатся такие сведения и документы о юрлице, как:
полное и сокращенное (при наличии) наименование, фирменное наименование для коммерческих организаций на русском языке;организационно-правовая форма;указание на наличие статуса международной компании или международного фонда;адрес юрлица в пределах его места нахождения;адрес электронной почты юрлица (если он указан в заявлении о госрегистрации);способ образования юрлица (создание или реорганизация);сведения об учредителях (участниках);подлинник или нотариально заверенная копия учредительного документа юрлица либо сведения о том, что юридическое лицо действует на основании типового устава, утвержденного в соответствии с федеральным законом;сведения о правопреемстве;способ прекращения юрлица;сведения о том, что юрлицо находится в процессе ликвидации;сведения о возбуждении производства по делу о банкротстве юрлица, о проводимых в отношении него процедурах, применяемых в деле о банкротстве;размер указанного в учредительных документах коммерческой организации уставного капитала (складочного капитала, уставного фонда, паевых взносов или другого);сведения о полученных юрлицом лицензиях;сведения о филиалах и представительствах юрлица;ИНН, код причины и дата постановки на учет юрлица в налоговом органе;коды по ОКВЭД;номер и дата регистрации юрлица в качестве страхователя в территориальном органе ПФР и исполнительном органе ФСС России;запись о недостоверности содержащихся в ЕГРЮЛ сведений и т. д. (ст. 5, п. 5 ст. 11 Федерального закона от 8 августа 2001 г. № 129-ФЗ «О государственной регистрации юридических лиц и индивидуальных предпринимателей»).
По общему правилу, содержащиеся в ЕГРЮЛ сведения и документы являются открытыми и общедоступными, за исключением сведений, установленных законом. Лицо, добросовестно полагающееся на данные ЕГРЮЛ, вправе исходить из того, что они соответствуют действительным обстоятельствам (абз. 2 п. 2 ст. 51 Гражданского кодекса).
