Глава Минпромторга России Денис Мантуров на итоговом заседании Госкомиссии по противодействию незаконному обороту промышленной продукции анонсировал начало эксперимента по маркировке минеральной и питьевой воды в январе 2020 года. Отметим, что соответствующим проектом постановления Правительства РФ, подготовленным в августе этого года, начало эксперимента предусматривалось с октября.
Министр сообщил, что несмотря на существенный разброс в показателях нелегального оборота воды (от 2% до 30 %), есть вероятность, что именно проведение эксперимента по маркировке в течение 9 месяцев следующего года поможет понять, стоит ли его продлить по окончании этого срока либо определиться с утверждением даты обязательной маркировки такого вида продукции. Вопрос об установлении контроля за оборотом питьевой и минеральной воды на российском рынке является одним из самых насущных в последнее время. Обсуждается, что ответственными за проведение указанного эксперимента помимо Минпромторга России будут назначены в пределах своего ведения Министерство цифрового развития, связи и массовых коммуникаций РФ, ФНС России, ФТС России, Роспотребнадзор, Федеральная служба по аккредитации, Роспатент и ФСБ России.
О результатах контрольных мероприятий по противодействию незаконному обороту минеральных и питьевых вод на днях на своем официальном сайте сообщил Роспотребнадзор (при этом, о точном периоде проверки в информации не указано). Согласно этим данным, службой проверено более 200 тыс. партий минеральной воды, объемом более 175 тыс. тонн. При этом сообщается, что в 75 % случаев проведенных проверочных мероприятий выявлены нарушения обязательных требований законодательства. Кроме того, имеют место случаи указания в маркировке воды предприятий-«призраков», которые фактически не существуют по адресам производства. В Роспотребнадзоре уверены, что маркировка питьевой и минеральной воды позволит не допустить попадания на рынок продукции, не соответствующей стандартам качества, и оперативно реагировать на выявление фальсификата.
Предполагается, что в течение эксперимента добровольно участвующие в нем производители продукции будут освобождены от платы за предоставление кодов маркировки, соответствующий проект постановления1 Правительства РФ Минпромторг России разместил 17 декабря на федеральном портале проектов нормативных правовых актов. Как известно, сегодня при обязательной маркировке товаров она составляет 0,50 руб. за один код маркировки без учета НДС, а при маркировке лекарственных препаратов, включенных в перечень ЖНВЛП, предельная отпускная цена производителя которых не превышает 20 руб., такая плата не взимается (Постановление Правительства РФ от 8 мая 2019 г. № 577 «Об утверждении размера платы за оказание услуг по предоставлению кодов маркировки, необходимых для формирования средств идентификации и обеспечения мониторинга движения товаров, подлежащих обязательной маркировке средствами идентификации, а также о порядке ее взимания»).
