Сумин составил акт сдачи-приемки выполненных работ и получил от пострадавших денежные средства в качестве оплаты работ. В тот же день во время работы водонагревателя двое находившихся в квартире малолетних детей потеряли сознание, а их мать, чувствуя недомогание, сообщила об этом своим родственникам.
Все члены семьи были доставлены в больницу с диагнозом «отравление угарным газом». Сумин был признан виновным по части 1 статьи 238 УК РФ («Выполнение работ или оказание услуг, не отвечающих требованиям безопасности жизни или здоровья потребителей»).
