Железнодорожный районный суд Ростова-на-Дону удовлетворил ходатайство защиты бывшего сотрудника агрохолдинга «МЭЗ Юг Руси» Александра Фисенко и вынес определение о назначении судебной финансово-экономической экспертизы документов по сделкам купли–продажи подсолнечника для «Юга Руси».«При этом суд принял во внимание наличие в уголовном деле заключения экспертизы и экспертного исследования, выводы которых противоречат друг другу», — уточнила адвокат Христина Василенко. Она напомнила, что ходатайство защиты о проведении экспертизы было заявлено еще в октябре, но оставалось без рассмотрения.
По информации адвокатов, суд поручил проведение экспертизы Российскому федеральному центру судебной экспертизы при министерстве юстиции РФ. Ранее адвокаты неоднократно заявляли, что имеющееся в материалах дела экспертное заключение, составленное специалистом ООО «Аудит и экспертиза», не может быть признано допустимым доказательством. Основанием для этого, по мнению защиты, является заинтересованность эксперта в исходе уголовного дела.
В 2014г. «Юг Руси» предъявил претензии к своему бывшему сотруднику Александру Фисенко, занимавшему в 2008-2012гг. пост замдиректора по коммерческим вопросам ростовского филиала кампании «Юг Руси Агро». Тогда Александр Фисенко закупил у поставщиков «Регион Продукт» и «Урал-Транзит» 17 тыс. тонн семян подсолнечника для «МЭЗ Юг Руси». В 2011г. крупная партия семян подсолнечника, переданная на хранение Сакмарскому элеватору (Оренбургская область), пропала.Ростовский агропромышленный холдинг «Юг Руси» пытается через суд взыскать убытки с бывшего сотрудника. Сумма гражданского иска холдинга к Александру Фисенко, обвиняемому в злоупотреблении полномочиями (ч.1 ст. 201 УК РФ), составляет более 164 млн руб.
