Соответствующее информационное письмо от 30 мая 2019 г. № ИН-06-59/46 опубликовано на официальном сайте регулятора. Оно касается порядка реализации кредитными организациями права на принятие мер по определению источников происхождения денежных средств и (или) иного имущества клиентов при их приеме на обслуживание и обслуживании.
Так, Банк России напомнил о проведении с 1 января 2019 года эксперимента по установлению специального налогового режима «Налог на профессиональный доход» в четырех субъектах РФ – Москве, в Московской и Калужской областях, а также в Республике Татарстан (Федеральный закон от 27 ноября 2018 г. № 422-ФЗ).
С целью исключения случаев принятия кредитными организациями необоснованных решений об отказах от проведения операций по причине поступления на банковские счета самозанятых денежных средств в виде профессионального дохода регулятор рекомендует1 при принятии мер, направленных на определение источников происхождения денежных средств, учитывать информацию о статусе клиента как самозанятого.

Кроме того, кредитным организациям следует фиксировать информацию о статусе клиента как самозанятого в его анкете (досье), чтобы в дальнейшем ее при необходимости могли использовать все заинтересованные подразделения кредитной организации (включая ее филиалы), в т. ч. в рамках информационных систем (электронных баз данных) кредитной организации.
