Банк России принял решение следовать принципам Глобального кодекса валютного рынка, сообщает1 пресс-служба регулятора. С соответствующим заявлением от 15 декабря 2021 года и с текстом Глобального кодекса валютного рынка можно ознакомиться на сайте Банка России.
Названный кодекс разработан Рабочей группой при Банке международных расчетов, в которую вошли представители центральных банков и профессиональных участников рынка из 16 стран, и является сводом основных правил добросовестной работы на валютном рынке. Банк России также призывает иных участников рынка придерживаться норм Глобального кодекса валютного рынка для формирования устойчивого, ликвидного, открытого и транспарентного валютного рынка на территории РФ, о чем сделать соответствующие заявления на своих сайтах.
Как следует из текста Глобального кодекса валютного рынка, он базируется на шести основных принципах, таких как:
Этика. Участники рынка должны действовать этично и профессионально, содействуя формированию справедливого и добросовестного валютного рынка; Управление. Участники рынка должны иметь механизмы управления, обеспечивающие четко определенные меры ответственности и всесторонний надзор за своей деятельностью на валютном рынке, а также способствовать ответственному поведению на валютном рынке; Заключение сделок и исполнение поручений. Участники рынка должны проявлять осмотрительность при согласовании и заключении сделок с целью формирования устойчивого, добросовестного, открытого, ликвидного и в должной степени прозрачного валютного рынка; Обмен информацией. Участники рынка должны быть точны и понятны при обмене информацией и должны обеспечивать защиту конфиденциальной информации с целью формирования устойчивого, добросовестного, открытого, ликвидного и в должной степени прозрачного валютного рынка; Управление рисками и комплаенс. Участники рынка должны обеспечивать и поддерживать надлежащий контроль, соблюдать процедуры комплаенса в целях выявления рисков и управления ими, а также предоставления отчетов о рисках, связанных с деятельностью Участников на валютном рынке; Подтверждение и расчеты. Участники рынка должны внедрять надежные, эффективные, прозрачные и снижающие риски пост-трейдинговые процессы, способствующие проведению предсказуемых, бесперебойных и своевременных расчетов по сделкам на валютном рынке.

Участниками рынка кодекс называет лицо или организацию, которые работают на валютных рынках в рамках своей обычной деятельности и вовлечены в операции по покупке и продаже одной валюты за другую. Участники управляют инфраструктурой, системами или платформами, посредством которых участники совершают эти операции, предоставляют услуги по заключению сделок с валютными бенчмарками, включая фиксинги, и не считаются розничными участниками рынка.
Это могут быть: финансовые учреждения, центральные банки, квази-суверенные и наднациональные организации, управляющие активами, суверенные фонды, хедж-фонды, пенсионные фонды и страховые компании, казначейский департамент или казначейский центр корпорации, заключающий внешние сделки, семейные офисы, проводящие казначейские операции, провайдеры услуг по исполнению сделок с бенчмарками, брокеры, розничные валютные дилеры, инвестиционные консультанты, ценовые агрегаторы, а также аналогичные посредники/агенты, компании, занимающиеся денежными переводами, обменные пункты и небанковские финансовые организации в части их работы на оптовом валютном рынке и т. д.
В кодексе раскрывается основное содержание каждого из принципов, примеры их конкретного применения, содержится глоссарий и образец заявления о приверженности принципам Глобального кодекса валютного рынка.
