Депутат Госдумы Олег Нилов внес на рассмотрение законопроект1, который запрещает утилизировать, уничтожать и проводить захоронение пригодных для еды пищевых продуктов, пищевых материалов и изделий.
Вместо этого супермаркеты или иные владельцы пищевых продуктов смогут безвозмездно отдавать гражданам продукты, до истечения срока годности которых осталось три и менее дня. Для владельцев пищевых продуктов будет также установлена налоговая льгота: передача продуктов с истекающим сроком годности будет освобождена от НДС.
Что касается некачественных продуктов или продуктов, срок годности которых уже истек, предлагается передавать их для переработки. Впоследствии из них произведут корма для животных.
В настоящее время установлен запрет на оборот продуктов с истекшим сроком годности, а также обязанность их владельцев провести утилизацию (п. 2.3, п. 1 ст. 24 Федерального закона от 2 января 2000 г. № 29-ФЗ «О качестве и безопасности пищевых продуктов»). Про продукты, у которых срок годности еще не истек, но уже подходит к концу, в законе ничего не сказано.
«Немыслимо в стране, где в памяти миллионов граждан голод войны, блокада Ленинграда, карточная система, пустые полки «90-ых», где и сегодня миллионы людей живут в бедности и нищете, уничтожение пригодных для употребления пищевых продуктов», — подчеркивает автор инициативы. Вместе с тем, по его данным, в России лишь за пять лет уничтожено свыше 36 тыс. тонн так называемых «санкционных продуктов». Эксперты также указывают, что ежегодно в России выбрасывается более 4 млн тонн просроченных продуктов.

В случае одобрения поправок изменения будут внесены в Федеральный закон от 24 июня 1998 г. № 89-ФЗ «Об отходах производства и потребления» и в НК РФ.
