С 1 января этого года на организаторов сервиса обмена мгновенными сообщениями возложена обязанность по проведению идентификации интернет-пользователей в порядке, определенном Правительством РФ (п. 1 ч. 4.2. ст. 10.1 Федерального закона от 27 июля 2006 г. № 149-ФЗ «Об информации, информационных технологиях и о защите информации», далее – закон об информации). Речь идет о проверке «привязки» учетных записей пользователей к их абонентским номерам.

Сегодня кабмин официально опубликовал постановление, которым установлен такой порядок (постановление Правительства РФ от 27 октября 2018 г. № 1279 «Об утверждении Правил идентификации пользователей информационно-телекоммуникационной сети «Интернет» организатором сервиса обмена мгновенными сообщениями»1). Так, для подтверждения абонентского номера пользователю будет предложено совершить действия с использованием этого номера, позволяющие достоверно установить, что он использует сообщенный абонентский номер при регистрации в мессенджере. Мессенджер будет запрашивать у оператора связи сведения о наличии или отсутствии в базах данных об абонентах информации об определенном пользователе. На предоставление указанных сведений у оператора связи будет 20 минут с момента получения запроса. Причем, если в указанный срок мессенджер не получит положительного ответа, то идентификация будет считаться непройденной.
Если абонент сменит оператора, или изменятся сведения о нем, то соответствующая информация будет направляться мессенджеру в течение суток, после чего он будет проводить повторную идентификацию в течение 20 минут с момента получения соответствующего уведомления.
Документ вступит в силу 6 мая, по истечении 180 дней с момента официального опубликования.
