Ключевые поправки касаются автомобилистов, налогоплательщиков, субъектов малого и среднего предпринимательства, потребителей коммунальных услуг, получателей пособий на детей и т. д. Всего в ноябре вступают в силу 103 федеральных акта, принятых к настоящему времени.
1. Начнет действовать закон об обязательных требованиях в РФ (с 1 ноября)
Он предусматривает признание до 1 января 2021 года утратившими силу, не действующими на территории РФ и отмену НПА Правительства РФ, федеральных органов исполнительной власти, актов РСФСР и СССР, содержащих обязательные требования, соблюдение которых оценивается при осуществлении госконтроля (надзора). Оценка соблюдения обязательных требований, вступивших в силу до 2020 года, будет недопустима, как и привлечение к административной ответственности за их несоблюдение. По общему правилу, положения НПА, устанавливающие обязательные требования, будут вступать в силу с 1 марта или с 1 сентября, но не ранее чем через 90 дней после официального опубликования соответствующего акта. А срок действия обязательных требований, закрепленных в подзаконных актах, ограничат шестью годами (с возможностью продления еще на шесть лет). Также к 1 марта 2021 года появится реестр обязательных требований, содержащий их перечень, информацию об установивших НПА и сроке их действия.
Кроме того, с начала месяца органы госвласти, имеющие полномочия по осуществлению госконтроля (надзора), лицензирования и аккредитации, начнут размещать на своих сайтах перечни НПА, содержащих обязательные требования, с указанием категорий лиц, обязанных их соблюдать, а также ссылок на положения об административной ответственности за несоблюдение требований.

2. Электронный европротокол можно будет оформить при наличии разногласий сторон (с 1 ноября)
С начала месяца станет возможным составление электронного извещения о ДТП при наличии у участников аварии разногласий относительно обстоятельств причинения вреда, характера и перечня видимых повреждений ТС. Это касается случаев, когда страховое возмещение не превышает 100 тыс. руб. Кроме того, водители смогут оформить европротокол в отношении транспортных средств организаций. При этом по-прежнему условием составления электронного извещения будет наличие хотя бы у одного из участников ДТП специального мобильного приложения, интегрированного с порталом госуслуг.
Отметим, на ноябрь намечено и распространение на всю территорию России мобильного приложения «Помощник ОСАГО», успешно протестированного в пяти «пилотных» регионах (Москве, Санкт-Петербурге, Московской и Ленинградской областях, Республике Татарстан). Изначально расширить географию действия приложения планировалось с 1 ноября, но из-за ограничительных антиковидных мер часть тестовых операций пришлось продлить. Но РСА готов запустить его в ноябре. Напомним, «Помощник ОСАГО» оптимизирует процесс оформления извещения о ДТП в электронном виде. Часть необходимых для этого данных (о водительском удостоверении, полисе ОСАГО) поступят из личного кабинета водителя на портале госуслуг и из АИС ОСАГО. Участникам нужно будет только проверить информацию, прикрепить фото с места ДТП и ввести недостающие сведения.

Пункт 1.1.4 п. 1 Указания Банка России от 16 июля 2020 г. № 5505-У «О внесении изменений в Положение Банка России от 19 сентября 2014 года № 431-П «О правилах обязательного страхования гражданской ответственности владельцев транспортных средств»
3. Появится новая форма бумажного ПТС (с 1 ноября)
Новая форма паспорта транспортного средства должна была применяться еще с 1 ноября 2019 года, но МВД России решило отложить срок ее введения на год. Напомним, ПТС относится к печатной специальной продукции, необходимой для допуска ТС и водителей к участию в дорожном движении. Он имеет учетный номер и полиграфические защитные элементы с установленным уровнем защиты от подделки. В требованиях к ПТС, которые также вступят в силу с начала месяца, оговорено, что бумажные ПТС оформляются взамен утраченных, пришедших в негодность, а также при невозможности их дальнейшего использования вследствие заполнения всех реквизитов об изменении собственников ТС. Замена производится подразделениями Госавтоинспекции по заявлению собственника при совершении регистрационных действий в отношении ТС.

4. Владельцы агрегаторов должны будут принимать к оплате карты «Мир» (с 1 ноября)
У них появится обязанность обеспечить для потребителей возможность осуществления расчетов в безналичном порядке с использованием национальных платежных карт. Это касается тех организаций и ИП – владельцев агрегатора информации о товарах (услугах), у которых годовой объем выручки товаров превышает 40 млн руб.

5. Сократится перечень сведений, запрашиваемых у заявителя при оказании госуслуг (с 1 ноября)
Будет дополнен перечень сведений и документов, которые нельзя требовать у заявителя при оказании госуслуг. В него включат сведения о средствах, перечисленных взыскателю со счета по учету средств, поступающих во временное распоряжение отдела судебных приставов, по исполнительному производству о взыскании алиментов. Предоставлять такие данные будет ФССП России. Ожидается, что эта поправка, в частности, упростит оформление пособия на детей от 3 до 7 лет, поскольку гражданам не придется самостоятельно предоставлять документы, содержащие сведения об алиментах.

6. Пополнится перечень маркируемых товаров (с 1 ноября)
Вводится обязательная маркировка шин и новых пневматических покрышек. Она предусматривалась с 1 декабря 2019 года, но этот срок был перенесен на 1 ноября 2020 года. Продавцы, производители и импортеры шин должны были зарегистрироваться в государственной информационной системе мониторинга за оборотом маркируемых товаров до 31 марта текущего года. С ноября участники оборота шин начнут вносить данные об операциях с шинами в информационную систему маркировки. Маркировать накопившиеся остатки немаркированных шин разрешается до 1 декабря.

7. Изготовленные в государствах – членах ЕАЭС ТС будут регистрироваться в России только по электронным ПТС (с 2 ноября)
Изначально Коллегия ЕЭК продлила возможность оформления бумажных ПТС до 1 ноября 2020 для всех государств – участников союза, а затем сдвинула этот срок до 31 марта 2021 года – однако, только для Республик Беларусь, Казахстан и Кыргызской Республики. Россия в этом списке не указана. Следовательно, ТС, изготовленные в государствах – членах ЕАЭС, будут регистрироваться в РФ только при наличии электронных ПТС уже начиная с 2 ноября. Соответствующие изменения внесены и в порядок функционирования систем электронных ПТС, утв. Решением Коллегии ЕЭК от 22 сентября 2015 г. № 122.

8. Будет обновлена форма декларации по налогу на имущество организаций (с 3 ноября)
В частности, в ней появятся строки: «Признак налогоплательщика» для определения тех налогоплательщиков, которым из-за COVID-19 продлили сроки уплаты налога (авансовых платежей); «Признак СЗПК» в целях определения налогоплательщиков, на которых распространяются нормы о стабилизации правил налогообложения имущества организации на период действия соглашения о защите и поощрении капиталовложений. Вместе с тем, появятся коды налоговых льгот в связи с освобождением наиболее пострадавших из-за пандемии организаций от уплаты налога за II квартал 2020 года. Также будут скорректированы коды видов недвижимого имущества. Корреспондирующие изменения внесены в порядок заполнения декларации и ее электронный формат. Обновленная форма будет применяться начиная с подачи декларации по налогу на имущество за налоговый период 2020 года. Контрольные соотношения к новой форме декларации доведены Письмом ФНС России от 30 сентября 2020 г. № БС-4-21/15947@.

9. Начнут действовать общие требования к определению допустимых отклонений от показателей качества и объема оказания госуслуг в соцсфере (с 3 ноября)
Предельные допустимые возможные отклонения от показателей, характеризующих качество и объем оказания государственной (муниципальной) услуги в соцсфере, будет определять уполномоченный орган при формировании государственного (муниципального) соцзаказа. Причем значения таких отклонений, включенные в госзадания и соглашения, можно будет менять только при формировании соцзаказа на очередной финансовый год.

10. Программа льготной ипотеки под 6,5% продолжится (с 5 ноября)
В начале месяца вступит в силу постановление Правительства РФ, предусматривающее внесение соответствующего изменения в правила возмещения кредитным и иным организациям недополученных доходов по жилищным (ипотечным) кредитам (займам), выданным гражданам РФ. Напомним, изначально предполагалось, что программа завершится 1 ноября, но в целях повышения доступности ипотеки в условиях сохраняющихся рисков COVID-19 ее решено продлить до 1 июля 2021 года. Хотя ранее обсуждался вариант продления и до конца следующего года. Напомним, программа позволяет гражданам при соблюдении определенных условий получить кредит на покупку жилья в новостройках по льготной ставке 6,5%. При этом разницу между льготной и рыночной ставками банкам возместит государство.

Постановление Правительства РФ от 24 октября 2020 г. № 1732 «О внесении изменений в некоторые акты Правительства Российской Федерации по вопросам возмещения кредитным и иным организациям недополученных доходов по жилищным (ипотечным) кредитам (займам), выданным гражданам Российской Федерации»
11. Завершится первый этап представления сведений для формирования единого реестра субъектов МСП – получателей поддержки (5 ноября)
Речь идет о сведениях относительно тех субъектов МСП, решения о предоставлении поддержки которых приняты за период с 1 января 2019 года по 1 октября 2020 года, а в отношении физлиц, не являющихся ИП и применяющих НПД, – за период с 1 июля по 1 октября. В целях первого размещения сведений, содержащихся в этом реестре, органы власти всех уровней, Корпорация МСП, ее дочерние общества, организации, образующие инфраструктуру поддержки субъектов МСП, до 5 ноября представляют в ФНС России необходимые сведения в форме электронных документов. А именно: наименование юрлица, Ф. И. О. ИП, физлица, применяющего спецрежим, их ИНН; наименование и ИНН предоставивших поддержку органов, Корпорации МСП, ее дочерних обществ, организаций, образующих инфраструктуру поддержки субъектов МСП; дата принятия решения о предоставлении или прекращении оказания поддержки; вид, форма и размер предоставленной поддержки; срок оказания поддержки; информация о наличии нарушения порядка и условий предоставления поддержки, в том числе о нецелевом использовании средств поддержки.

12. Появится уголовная ответственность за подкуп арбитра (с 7 ноября)
Новая статья Уголовного кодекса закрепит санкции как для дающего взятку, так и для арбитра (третейского судьи), принимающего ее. Первым грозит ответственность в виде штрафа до 400 тыс. руб. или в размере от пятикратной до двадцатикратной суммы подкупа, либо ограничение свободы или исправительные работы на срок до двух лет, либо лишение свободы на тот же срок со штрафом в размере до пятикратной суммы подкупа или без такового. Вторым – штраф до 700 тыс. руб. или в размере от десятикратной до тридцатикратной суммы подкупа либо лишение свободы на срок до трех лет со штрафом до пятнадцатикратной суммы подкупа или без него. За деяния с квалифицирующими признаками, включая взятки в значительном (более 25 тыс. руб.), крупном (свыше 150 тыс. руб.) и особо крупном (более 1 млн руб.) размерах, установлены повышенные санкции.

Федеральный закон от 27 октября 2020 г. № 352-ФЗ «О внесении изменений в Уголовный кодекс Российской Федерации и статью 151 Уголовно-процессуального кодекса Российской Федерации»
13. Изменится норма об ответственности коммунальных служб за перебои в работе и нарушение качества услуг (с 7 ноября)
Из ч. 4 ст. 157 Жилищного кодекса исчезнет указание на обязанность лица, виновного в нарушении непрерывности предоставления или качества коммунальных услуг, уплатить потребителю штраф. Хотя в Постановлении Правительства РФ от 6 мая 2011 г. № 354 сохранится положение о праве потребителя требовать с исполнителя уплаты неустоек (штрафов, пеней) в рамках Закона «О защите прав потребителей», в том числе в случае превышения допустимых перерывов в предоставлении коммунальных услуг (п. 157 Правил предоставления коммунальных услуг собственникам и пользователям помещений в многоквартирных домах и жилых домов).
В Жилищном кодексе РФ останется лишь норма о необходимости осуществления перерасчетов размера платы за коммунальные услуги при предоставлении их с перерывами, превышающими установленную продолжительность. Предоставление коммунальных услуг с нарушением качества тоже будет основанием для изменения размера платы за них. Осуществлять перерасчет будут управляющие организации, ТСЖ, жилищные или иные специализированные потребительские кооперативы, ресурсоснабжающие организации и региональные операторы по обращению с ТКО.
Грамотно составить исковое заявление о взыскании излишне уплаченных денежных средств за жилищно-коммунальные услуги поможет примерная форма, подготовленная экспертами компании «Гарант».

14. Будет уточнен порядок ведения реестра субъектов МСП (с 7 ноября)
В частности, поправки касаются корректировки сроков внесения сведений о юрлицах и ИП в единый реестр субъектов МСП и исключения таких сведений. Согласно документу внесение и исключение сведений уполномоченный орган будет осуществлять в периоды с 10 июля по 10 декабря и с 10 января по 10 июня. Будут учитываться сведения из ЕГРЮЛ, ЕГРИП, документов, связанных с применением специальных налоговых режимов, и сведения, представленные в уполномоченный орган в установленном порядке. Кроме того, изменения предусматривают включение торгово-промышленных палат в перечень организаций инфраструктуры поддержки субъектов МСП, что позволит им участвовать в региональных и муниципальных программах поддержки бизнеса.

15. Возобновится беззаявительный порядок назначения выплат на детей (с 7 ноября)
Вступит в силу поправка, предусматривающая назначение ежемесячной выплаты в связи с рождением (усыновлением) первого и (или) второго ребенка семьям с низким доходом без подачи гражданами нового заявления. Напомним, ранее в связи с распространением новой коронавирусной инфекции действие нормы, обязывающей подавать соответствующие заявления на получение выплаты при достижении ребенком возраста одного года или двух лет, было приостановлено с 1 апреля по 1 октября включительно. Теперь же решено продлить период приостановления действия указанного положения до 1 марта 2021 года. Причем изменение имеет обратную силу и распространяется на правоотношения, возникшие с 1 октября текущего года.

16. Изменится форма налоговой декларации по НДС (с 9 ноября)
Поправки, большинство из которых связаны с принятием Закона о защите капиталовложений и расширением перечня необлагаемых НДС операций, затронут не только форму декларации, но и ее формат. Также они коснутся форматов предоставления сведений из книги покупок, продаж, журналов учета полученных и выставленных счетов-фактур. Актуализированная форма будет применяться начиная с декларации по НДС за IV квартал текущего года.

Приказ ФНС России от 19 августа 2020 г. № ЕД-7-3/591@ «О внесении изменений в приложения к приказу Федеральной налоговой службы от 29 октября 2014 года № ММВ-7-3/558@ «Об утверждении формы налоговой декларации по налогу на добавленную стоимость, порядка ее заполнения, а также формата представления налоговой декларации по налогу на добавленную стоимость в электронной форме»
17. Будет скорректирована форма налоговой декларации по налогу на прибыль организаций (с 16 ноября)
В частности, из титульного листа исчезнет строка о регистрационном номере декларации, будут пересмотрены штрих-коды. В числе корректировок – уточнение расчета инвестиционного вычета, введение новых кодов неучитываемых доходов и признаваемых расходов. Остальные поправки связаны с налогообложением прибыли IT-компаний, резидентов Арктической зоны и участников специальных инвестконтрактов. Применяться они будут начиная с декларации за налоговый период 2020 года, но не ранее 1 января следующего года.

Приказ ФНС России от 11 сентября 2020 г. № ЕД-7-3/655@ «О внесении изменений в приложения к приказу Федеральной налоговой службы от 23.09.2019 № ММВ-7-3/475@ «Об утверждении формы налоговой декларации по налогу на прибыль организаций, порядка ее заполнения, а также формата представления налоговой декларации по налогу на прибыль организаций в электронной форме»
18. Пассажирскую таможенную декларацию разрешат подавать в электронном виде (с 16 ноября)
С середины месяца начнет действовать новая редакция порядка подачи и регистрации пассажирской таможенной декларации, которая оформляется на товары для личного пользования и ТС, перемещаемые гражданами через границу ЕАЭС. Декларацию будет разрешено подавать не только в бумажном, но и в электронном виде (с помощью ЕАИС таможенных органов, информсистемы декларанта или терминалов в таможенных органах). С 16 ноября утратит силу действующий порядок регистрации пассажирских таможенных деклараций.

Приказ Минфина России от 14 сентября 2020 г. № 194н «Об утверждении порядка подачи, регистрации или отказа в регистрации пассажирской таможенной декларации»
19. Вступят в силу обновленные формы документов, предоставляемых при госрегистрации организаций и ИП (с 25 ноября)
Новые формы учитывают изменения законодательства, принятие с момента утверждения действующих форм. В частности, появится возможность отразить в ЕГРЮЛ сведения о (об): использовании типового устава ООО; корпоративном договоре; совместном или раздельном осуществлении полномочий руководителями юрлица; сочетании форм реорганизации; продлении срока ликвидации ООО. Также появятся поля для указания места нахождения и адреса юрлица, сведений о его электронном адресе, наименовании на иностранном языке, об ограничении доступа к сведениям ЕГРЮЛ в установленных законом случаях, о произведенных выплатах увольняемым в связи с ликвидацией работникам и т. п. Будут введены и новые формы – например, форма заявления для госрегистрации международной компании, международного фонда, но в целом общее количество используемых бланков сократится с 19 до 12. Приказ ФНС России от 31 августа 2020 г. № ЕД-7-14/617@ «Об утверждении форм и требований к оформлению документов, представляемых в регистрирующий орган при государственной регистрации юридических лиц, индивидуальных предпринимателей и крестьянских (фермерских) хозяйств»
20. Истечет срок для подачи заявлений об отсрочке или рассрочке уплаты налогов (30 ноября)
ФНС России завершит прием заявлений от налогоплательщиков, занятых в пострадавших от распространения новой коронавирусной инфекции отраслях экономики, 30 ноября. Заявление можно подать в налоговый орган по месту нахождения или учета налогоплательщика по тем платежам, сроки уплаты которых приходятся на 2020 год, включая период с 1 по 31 декабря. Заявление, поданное до направления в инспекцию деклараций или расчетов, в которых исчислены указанные в нем налоги, авансовые платежи и страховые взносы, будет рассмотрено после их представления. С момента подачи заявления до момента принятия решения по нему налоговым органом не будут применяться меры по взысканию задолженности. Проверить возможность получения рассматриваемой меры поддержки можно с помощью специального сервиса на официальном сайте ФНС России. Напомним, отсрочки и рассрочки предоставляются беспроцентно.
