Законодательное Собрание Калужской области выступило с указанной инициативой, сославшись на результаты мониторинга соблюдения правил торговли такой продукцией вблизи образовательных организаций на территории области. По его итогам выяснилось, что табачные изделия продаются ближе 100 метров от них, а торговые организации уплачивают штраф за совершение этого правонарушения и продолжают нарушать установленный запрет.
Чтобы это предотвратить, предлагается установить следующие увеличенные размеры административных штрафов за несоблюдение ограничений в сфере торговли табачной продукцией и табачными изделиями:
от 3 тыс. до 4 тыс. руб. (вместо от 2 тыс. до 3 тыс. руб.) для граждан; от 6 тыс. до 11 тыс. руб. (вместо от 5 тыс. до 10 тыс. руб.) для должностных лиц; от 40 тыс. до 60 тыс. руб. (вместо от 30 тыс. до 50 тыс. руб.) для юрлиц1.
В этих целях предполагается внести изменения ч. 1 ст. 14.53 КоАП РФ. Вместе с тем менять размеры административных штрафов по другим частям этой статьи за оптовую или розничную продажу насвая и сосательного табака, а также продажу несовершеннолетнему табачной продукции или табачных изделий не планируется. Напомним, что в первом случае максимальный размер санкции для юрлица составляет 60 тыс. руб. (ч. 2 ст. 14.53 КоАП), а во втором – 150 тыс. руб. (ч. 3 ст. 14.53 КоАП).
